Case #7: Public Hearing - Request to Rezone from R -1 Single Family <br />Residential to Planned Unit Development (PUD) for Bridgewaters; <br />Case of CBR Development <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:50 <br />p.m. in order to call the public hearing to order. <br />Public Hearing <br />Chairperson Nixt called the public hearing to order at 8:50 p.m. <br />Presentation <br />Associate Planner Dalnes stated on May 4, 2007, CBR Development submitted a <br />rezoning application, in conjunction with a preliminary plat application to develop 5 <br />single - family lots on the property located to the east of Nowthen Boulevard and north of <br />Sunwood Drive at 14765 Nowthen Boulevard. The applicant has requested a rezoning <br />from R -1 Single - Family Residential to Planned- Unit - Development to accommodate 5 <br />single - family lots on the subject property. The site is 1.5 net acres, and currently <br />accommodates one, single - family farmhouse. The applicant is seeking to develop 5 lots, <br />and does not meet the standards established in the R -1 district. Staff directed the <br />applicant to seek a PUD rezoning as an alternative to multiple variances in order to <br />accommodate 5 lots. Ms. Dalnes stated the proposed lots meet the minimum lot size in <br />terms of area. However, 4 of the 5 lots fail to meet lot width requirements due to the <br />positioning of the lots on the cul -de -sac. Also, the proposed cul -de -sac does not meet the <br />standard requirements for right -of -way radius of 60 feet. Third, the maximum density in <br />the single - family residential district is 3 units per net acre, and this plat is proposing 3.3 <br />units per acre. The size of the property limits the applicant from obtaining an exact 3 <br />units per acre. The applicant is attempting to develop single - family, single -level living <br />units, and is requesting these deviations in order to accommodate this style of housing. <br />Ms. Dalnes stated City Code discusses general and specific requirements for allowing <br />zoning amendments to Planned Unit Development (PUD). She reviewed the following <br />criteria: <br />Hi h Quality Design and Compatibility with Sur Land Uses <br />The surrounding land use is single - family residential. The lot sizes, house design, and <br />density specifications are not substantially different from the surrounding land uses. The <br />submitted building elevations indicate a single -level product with front porches and two- <br />car garages. <br />Provision of a Wider Range of Housing Types Price Ranges, and Styles <br />The application is proposing to construct one -level living. This is a newly emerging <br />housing option targeted for primarily empty- nesters and seniors. However, it is unclear <br />whether the proposed housing units will provide a wide range of options. <br />Public Amenities and Open Space <br />—254— <br />
