Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #07 -06 -_ <br />RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO THE <br />REQUEST TO REZONE CERTAIN PROPERTY FROM R -1 SINGLE - FAMILY <br />RESIDENTIAL TO PLANNED UNIT DEVELOPMENT <br />WHEREAS, the City received an application to rezone certain property in accordance <br />with Section 9.03.03 (Zoning Amendments) and 9.20.31 (Planned Unit Development) of the <br />Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That CBR Development, hereinafter referred to as "Applicant," has properly applied to <br />rezone certain property from R -1: Single - Family Residential to Planned Unit Development. <br />2. That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on June 7, 2007 and said public hearing was properly advertised, and the <br />minutes of said public hearing are hereby incorporated by reference. <br />3. That the property proposed to be rezoned is legally described as follows: <br />The Southeasterly 288.96 feet (as measured at a right angle to the centerline of Nowthen <br />Boulevard) of that part of the Northeast Quarter of the Northeast Quarter of Section 26, <br />Township 32, Range 25, Anoka County, Minnesota, and part of the Northwest Quarter of <br />the Northwest Quarter of Section 25 of said Township 32, Range 25, described as follows: <br />Beginning at the intersection of the centerline of Nowthen Boulevard and the <br />North line of said Section 26; thence Southeasterly along the centerline of said Nowthen <br />Boulevard 891.00 feet; thence Northeasterly and at a right angle to said Nowthen Boulevard <br />264.00 feet; Northwesterly to the Northeast corner of said Section 26; thence West along <br />the North line of said Section 26 to the point of beginning, except the record plat of Ramsey <br />Commons 2nd Addition. <br />4. That the total area of the property to be rezoned is 1.5 acres. <br />5. That the proposed rezoning is located within the Metropolitan Urban Service Area (MUSA) <br />boundary. <br />6. That the Subject Property is currently zoned R -1 Single Family Residential. <br />7. That the only viable option to develop the Bridgewater plat, as proposed, requires use of the <br />Planned Unit Development rezoning. <br />-262- <br />
