TEMPORARY CONSTRUCTION EASEMENT AGREEMENT <br />This Agreement is dated June, 1!9 _ 2007 and is by and between Scott S. and Jill M. <br />Martinson, husband and wife ( "Grantor ") and the CITY OF RAMSEY, a municipal corporation organized <br />under the laws of the State of Minnesota ( "Grantee "). <br />Whereas, Grantor is the owner of real property located in Anoka County, Minnesota, and legally <br />described as follows: <br />Lot 4, Block 1 Greenland Hills, Anoka County, Minnesota <br />Whereas, the Grantee desires a 20 foot temporary construction easement described as follows: <br />The south 20 feet of Lot 4, Block 1 Greenland Hills, Anoka County, Minnesota <br />Now, therefore, in consideration of the sum of Five Hundred Dollars, it is agreed by and between <br />the parties hereto as follows: <br />(1) Temporary Construction Easement: to expire 60 days after Temporary <br />Construction Easement is signed. <br />(2) Lawn: To be restored to the condition prior to construction <br />(3) Trees: Existing trees along the south property line will be evaluated by a tree <br />expert as to the condition and value of each tree prior to construction. In the <br />event one year from the expiration date of the temproary construction easement <br />the trees die, and the cause is determined to be related to the construction activity <br />the grantor is to receive the prior to construction value of the tree. <br />(4) Stump: One stump to be removed in front yard provided that there are no <br />underground utilities in or near the stump. <br />IN WITNESS WHEREOF, the said Landowners have caused this agreement to be <br />executed as of the day and year first above written. <br />-367- <br />
