<br />Mayor Gamec stated technically this does not need to go out for RFP, and the Anoka County <br />Union is the City's official paper. <br /> <br />Mr. Graham replied he feels it is a little biased that Chief Way took the time to notify North Star <br />Towing. <br /> <br />Mayor Gamec stated he does not think so. They have had very good service and the RFP <br />process was published in the paper. <br /> <br />Councilmember Look stated he feels Chief Way met the minimum requirements of the law. <br />Neighboring cities handle this by sending out a courtesy letter to companies they know are viable <br />candidates. The intent of the Council was to get a competitive comparison among the real <br />players. Because people do not receive the Anoka County Union does not necessarily mean they <br />will read it. In order to have actually met the intent of the Council they should have sent out a <br />courtesy letter to all the available players to say please bid on this if you are able to, we are <br />looking for competitive numbers. He feels the fact that the Council made that recommendation <br />and the fact that they spent money in putting this in the paper, it was a complete waste of money. <br />It was an exercise in futility that they spent this money and did not get the intent and will end up <br />with the same result. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Jeffrey, to adopt Resolution #07-06-139 <br />authorizing the contracted services of North Star Towing, per the terms and conditions of the <br />contract. <br /> <br />Further discussion: Councilmember Jeffrey stated he is a little perplexed. He requested advice <br />from legal counsel on whether the City did what was required legally. He pointed out that Mr. <br />Bowtan was at the meeting and understood this would go out for RFP. From his perspective and <br />doing this in the state system,! they advertise and people call to say they are interested and would <br />like the information, or they respond to the RFP as advertised. City Attorney Goodrich advised <br />there is no state law requirement to do anything pertaining to service of this nature; the law has <br />not been violated. However, it is pretty much the City's standard procedure to send these types <br />of proposals to those parties who typically are in this type of business; this seems to be <br />somewhat unfair to not allow this gentleman to be able to make a proposal. Councilmember <br />Jeffrey stated he is concerned. He questioned if this is the City's responsibility or Mr. Bowtan's <br />responsibility knowing it was coming up and Chief Way saying he needed one week to have it <br />ready. Councilmember Dehen stated to that point he is also concerned about that. This <br />gentleman could have shot a. letter in and said he was interested, or put in an email. There is <br />some stake on this particular gentleman as he views it that he did not take more steps, yet on the <br />other hand there was at least an appearance at a Council meeting to get this information, and so <br />he thinks there is fault on both parts as he views it. He is looking at the perceived unfairness of <br />this and he does see some unfairness here. If they go forward and approve this he would <br />question if they are sanctioning that unfairness, which he is concerned about. Councilmember <br />Jeffrey suggested the policies and procedures should be reviewed to be sure they are understood. <br />He stated with the RFP's he has issued in the past for different services and products, he does not <br />send them to a different group of vendors. It gets published in state publications and it is up to <br />those folks who want the business to gather that information, inquire and proceed.
