Certificate of Survey will result in a single family home site which will reasonably conform to the <br />neighborhood. Mr. Jankowski recommended the following conditions should be included in the <br />mining and grading permit: 1) The applicant shall pay the cost associated with the patching of the <br />pavement of Juniper Ridge Drive, where the pavement was broken up by the tractor hauling <br />material to the site. This cost shall be agreed to be $250; and 2) The applicant agrees to grade the <br />lot in Certificate of Survey, prepared by Charles F. Anderson and dated November 15, 1996; and <br />3) The applicant agrees to establish turf over all disturbed area by seeding or sod before June 1, <br />1997. <br /> <br />Councilmember Haas Steffen recalled a resident or two getting up and speaking about the fill being <br />placed and some concern about what the filling of this lot would do. She asked if these fears have <br />been alleviated. <br /> <br />Mr. Jankowski stated that this was discussed at the Planning Commission and he believed all had <br />been resolved. <br /> <br />Councilmember Haas Steffen stated that when she heard the fill had been placed before a permit <br />had been taken out, she wondered if the City levies any type of fine for that. <br /> <br />Mr. Schroeder stated that we have not in past circumstances. We have talked to a number of <br />neighbors to find out measures that need to be taken with no negative impact to the neighborhood. <br /> <br />Mayor Gamec stated that he had talked with the City Engineer about this same thing. He suggested <br />if the Building Official or Inspector or members of the street crew see any digging, filling, etc., <br />they should bring it to the attention of the City Engineer. <br /> <br />Mr. Jankowski reiterated that the drainage had previously drained to a particular lot and a culvert <br />that was supposed to be put in was never done. A temporary easement was placed over this lot <br />until the drainage was addressed. In 1990, a new reservoir was created for that drainage. The area <br />we had talked about is, after this is filled, what happens to the immediate neighbor to the south. <br />For the most part, drainage would be virtually unchanged. The lowest part is actually on the <br />neighbor's property. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to adopt <br />Resolution t~)7-01-012 adopting Findings of Fact #0416 relating to a request from Robert W. <br />Berglund and Juniper Ridge Partnership for a conditional use permit for grading and filling. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Beahen and Haas <br />Steffen. Voting No: CouncilmemberBeyer. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to adopt <br />Resolution #97-01-013 approving the issuance of a conditional use permit based on Findings of <br />Fact ~)416 and declaring terms of permit for the grading and filling. <br /> <br />Motion carried. Voting No: CouncilmemberBeyer. <br /> <br />Case #4: Request for Conditional Use Permit for Grading and Filling in <br /> Section 3; Case of John Peterson <br /> <br />City Engineer Jankowski stated that this case deals with some mining that had gone on after the <br />fact. He explained that Mr. John Peterson owns the Northeast Quarter of the Northeast Quarter of <br />Section 9, and claims access to the property through an approximate 1,600 foot easement located in <br />the Southwest Quarter of the Southwest Quarter of Section 3.
