Further discussion: Councilmember Haas Steffen inquired if Council will be pressured to vote <br />on the zoning issue. Attorney Goodrich responded there's case law. If the property is included <br />within the MUSA, this City Council is obligated to do the rezoning. If rezoning fails, Mr. <br />Goodrich had no doubt this would end up in court as that action would be seen as arbitrary and <br />capricious. <br /> <br />Amendment carried. Voting No: None. <br /> <br />Case #2: <br /> <br />Request for Preliminary Plat Approval of Alpine Estates; Case of K.C. Land <br />Company <br /> <br />Zoning Administrator Frolik stated that Chuck Lund of K.C. Land Company is requesting <br />preliminary plat approval of the proposed plat of Alpine Estates. The property is situated in the <br />northwest quadrant of the intersection of County Road #57 and 153rd Avenue NW. The plat will <br />be served by two accesses from 153rd Avenue and none of the lots will have direct access onto <br />153rd. The proposed plat consists of 21 acres and with proper zoning, is eligible for <br />approximately 54 lots. However, in response to concerns of area residents, the City established <br />as a condition of the sale that the maximum number of lots created on the property would not <br />exceed 38 and that a maximum of 17 lots would be platted along the north property line adjacent <br />to pre-existing larger, rural residential lots. Ms. Frolik continued that the minimum lot size in <br />the urban district is 10,800 square feet; the average lot size in Alpine Estates is 14,759 square <br />feet. The minimum lot width is 80 feet in the urban district. The average lot width on the 17 lots <br />abutting the rural residential property to the north is 121.4 feet; the width of the rural lots is 135 <br />feet.
