The Planning Commission and staff recommend final plat <br />approval. <br /> <br />City Attorney Goodrich stated that with regard to final plat approval, it would be contingent <br />upon rezoning, however, the City is obligated to rezone to be in compliance. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to adopt <br />Resolution #97-05-134 granting final plat approval to Alpine Estates contingent upon rezoning <br />and compliance with the City Staff Review Letter. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #13: <br /> <br />Adopt Ordinance to Rezone Certain Property from B-1 and B-2 Business to <br />R-1 Urban Residential; Case of Good Value Homes <br /> <br />Zoning Administrator Frolik stated that at the last meeting, Council introduced an ordinance to <br />rezone the property located north of 153rd and west of T.H. #47 to facilitate the development of <br />single family homes on the site. The property is approximately 20 acres and is in the MUSA. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to adopt the <br />ordinance to rezone the proposed plat of Sunflower Ridge to R-1 Urban Residential. <br /> <br />A roll call vote was performed by the Recording Secretary. <br /> <br />Councilmember Haas Steffen aye <br />Councilmember Beahen aye <br />Councilmember Zimmerman nay <br />Councilmember Beyer nay <br />Mayor Gamec aye <br /> <br />Motion failed. <br /> <br />City Attorney Goodrich stated that this was for final zoning approval and needed a 4/5 vote to <br />carry. Now staff must be instructed to do the findings in the negative so a court could not deem <br />this action arbitrary and capricious. <br /> <br />Case #14: <br /> <br />Request to Rezone Property from R-1 Rural Residential to R-1 Urban <br />Residential; Case of Good Value Homes and Jake Barthold <br /> <br />Zoning Administrator Frolik stated that this case is to consider rezoning of the proposed Apple <br />Ridge plat. The ordinance can be amended to delete that approximate 5.5 acres that is not <br />included in the MUSA. This would be a decrease as opposed to an increase, and would not <br />require a public hearing.
