type of detached townhomes and reduced setbacks. The City Council considered the preliminary <br />plat and a zoning amendment to PUD for GAD's Prairie and unanimously approved both <br />requests on a 6 -0 vote, with Councilmember Jeffrey absent. Ms. Dalnes stated since May of <br />2006, the Stritesky's have sold their interests in GAD's Prairie to Tri -Cor Development. After <br />unsuccessfully seeking a revised preliminary plat proposal, Tri -Cor has submitted a final plat <br />application that substantially conforms to the approved preliminary plat. At the City Council <br />meeting on May 22, 2007, the City Council tabled action on the final plat for the applicant to <br />come back with a revised plan that indicates the ability to accommodate a future cul -de -sac on <br />the property. The applicant has revised the final plat sheet to indicate a full -size cul -de -sac on <br />the 9roperty that would replace access onto CSAH 5 when Helium Street is extended north to <br />146 Avenue. However, it requires the re- location of the stormwater pond and re- positioning of <br />the units on the property. The revised final plat is included in the Council's packet. In essence <br />the plan proposes to relocate the pond and develop the two lots to the north that were formerly <br />outlots because of that pond. <br />Associate Planner Dalnes stated staff is requesting that both the southern cul -de -sac and the <br />northern temporary cul -de -sac be constructed at this time. This would take minor revisions to <br />the exhibit. The purpose of this is to avoid potential conflicts with attempting to construct the <br />cul -de -sac at a later date after residents are living there. Due to the cul -de -sac configuration the <br />PUD agreement has established with the development agreement, there will need to be a <br />stipulation for reduced front yard setback for those two lots on the south side of approximately <br />10 feet. The Fire Chief has reviewed the potential future cul -de -sac and the future length would <br />be approximately 980 feet from 146 Avenue to the terminus. The Fire Chief is comfortable <br />with this length due to the proximity to the Nowthen Boulevard right -of -way and also that this is <br />a hydrogenated area. There are similar cul -de -sacs in the City. The Fire Chief would like it <br />noted that any fencing or additional significant screening efforts would impact the ability to <br />easily access this property from Nowthen Boulevard. Staff recommends any additional <br />screening be small shrubbery or other landscaping efforts. Staff is recommending approval <br />contingent upon the City Staff Review Letter, the developer entering into a development PUD <br />agreement, and the approval of an acceptable grading plan indicating a revised pond location. <br />The applicant is requesting Council action before any further revisions are made to the site plan. <br />Property owner Tim Boe is present to answer any questions of the Council <br />Councilmember Jeffrey stated he has not been in favor of this because of the access issue. The <br />County letter discusses this as not being a favorable access. The understanding is that the access <br />to 146 Avenue cannot be achieved at this time. He is not in favor of dumping more cars onto <br />Highway 5, and this does not work for him. <br />Motion by Councilmember Jeffrey, seconded by Councilmember Dehen, to deny the final plat of <br />GAD's Prairie. <br />Further discussion: City Attorney Goodrich advised findings of facts need to be adopted for a <br />motion to deny. Mayor Gamec stated they previously had both positive and negative findings, <br />and they then told the applicant to bring this back and address the cul -de -sac. They are now <br />looking at denying this when he brought it back. He noted Councilmember Jeffrey has been <br />consistent with his denial.
