applicable time period will result in summary abatement <br />procedures, and that the cost of abatement will be assessed against <br />the subject property. Upon expiration of the time required by the <br />notice, the City Administrator or his/her designee may abate the <br />nuisance. <br />e. Record of Abatement Costs and Billing. The Chief of Police, or <br />his or her designee, shall keep a record of the costs of abatement <br />performed under this Section and shall report monthly to the <br />Finance Officer all work performed for which the property owners <br />shall be billed. The invoices shall state and certify the description <br />of the land, lots or parcels involved and the amount assessable to <br />each. <br />f. Certification of Unpaid Abatement Costs to County Auditor. On <br />or before September 1 of each year, the Finance Officer shall list <br />the total unpaid charges for each abatement against each separate <br />lot or parcel to which they are attributable under this Ordinance. <br />After notice and hearing as provided in Minnesota Statutes Section <br />429.061, the Council may then spread the charges against property <br />benefited as a special assessment under Minnesota Statues, Section <br />429.101 and other pertinent statutes for certification to the County <br />Auditor and collection along with current taxes the following year, <br />or in annual installments, not exceeding ten, as the Council may <br />determine in each case. <br />Subd. 5 Interference Prohibited. <br />a. Interference. It is a misdemeanor for any person to prevent, delay <br />or interfere with the City or their agents while they are engaged in <br />the performance of duties set forth in this Section. <br />Subsection 5.12.04 (Penalty) is hereby repealed and replaced with the following language: <br />5.12.04 Penalty. Nothing in this Subsection shall prohibit the City from seeking <br />prosecution as a misdemeanor for any violation of this ordinance. <br />SECTION 3. SUMMARY <br />The following official summary of Ordinance #07 -_ has been approved by the City Council of <br />the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br />It is the intent and effect of Ordinance #07 - to amend Ramsey City Code Chapter 5 (Municipal <br />Regulations) to implement an abatement program that will give the City the authority to enter <br />onto property to correct City Code violations and assess the costs back to the affected property <br />owner when the property owner fails to perform said corrections.
