applicable time period will result in summary abatement procedures, and that the cost of abatement will be assessed against the subject property. Upon expiration of the time required by the notice, the City Administrator or his/her designee may abate the nuisance. e. Record of Abatement Costs and Billing. The Chief of Police, or his or her designee, shall keep a record of the costs of abatement performed under this Section and shall report monthly to the Finance Officer all work performed for which the property owners shall be billed. The invoices shall state and certify the description of the land, lots or parcels involved and the amount assessable to each. f. Certification of Unpaid Abatement Costs to County Auditor. On or before September 1 of each year, the Finance Officer shall list the total unpaid charges for each abatement against each separate lot or parcel to which they are attributable under this Ordinance. After notice and hearing as provided in Minnesota Statutes Section 429.061, the Council may then spread the charges against property benefited as a special assessment under Minnesota Statues, Section 429.101 and other pertinent statutes for certification to the County Auditor and collection along with current taxes the following year, or in annual installments, not exceeding ten, as the Council may determine in each case. Subd. 5 Interference Prohibited. a. Interference. It is a misdemeanor for any person to prevent, delay or interfere with the City or their agents while they are engaged in the performance of duties set forth in this Section. Subsection 5.12.04 (Penalty) is hereby repealed and replaced with the following language: 5.12.04 Penalty. Nothing in this Subsection shall prohibit the City from seeking prosecution as a misdemeanor for any violation of this ordinance. SECTION 3. SUMMARY The following official summary of Ordinance #07 -_ has been approved by the City Council of the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. It is the intent and effect of Ordinance #07 - to amend Ramsey City Code Chapter 5 (Municipal Regulations) to implement an abatement program that will give the City the authority to enter onto property to correct City Code violations and assess the costs back to the affected property owner when the property owner fails to perform said corrections.
