Case #8: Consider Extension of Residential Rezoning and Subdividing Moratorium <br /> <br />City Attomey Goodrich stated that on June 10, 1997, the Council passed a six month <br />development moratorium on residential rezoning and subdividing. That moratorium will expire <br />on January 13, 1998. The Comprehensive Plan amendment and studies are proceeding in a <br />timely fashion. However, this process will not be completed by the expiration date of the current <br />moratorium. He explained that an extension would be necessary to protect this planning process. <br />On December 3, 1997, Council, at a special meeting, introduced an ordinance extending this <br />moratorium. This ordinance is being presented for formal adoption. <br /> <br />Motion by Councilmember Zimmerman and seconded by <br />Ordinance #97-18 extending the term of the residential <br />additional six months. <br /> <br />Councilmember Beyer to adopt <br />development moratorium for an <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Beyer, Beahen and <br />Haas Steffen. Voting No: None. <br /> <br />Case #9: Adopt Ordinance Repealing Ordinance Establishing Development <br /> Assessment Fees <br /> <br />Council introduced an ordinance on l~n:a~.:_3t 24, 1997, repealing Ordinance #96-04 which <br />established development assessment fees on all new subdivisions. This ordinance was never <br />brought back to Council for formal adoption. Staff is reviewing subdivision dedication fees and <br />will provide an update and proposal to the Council at their January 27, 1998 meeting. Also, the <br />League of Cities is proposing legislation for the 1998 legislative session which would authorize <br />cities to collect impact fees. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Ordinance #97-19 which repeals Ordinance #96-04 entitled "An Ordinance Establishing a <br />Development Assessment on all New Subdivisions". <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Mayor Gamec recessed the regular Council meeting at 8:53 p.m. <br /> <br />Mayor Gamec reconvened the regular Council meeting at 9:06 p.m. <br /> <br />Case #10: Halderson Land Purchase Status <br /> <br />Mayor Gamec noted that the Halderson land is the property Council looked at for park land. It is <br />approximately 83 acres west of T.H. #47 and east and south of Menkveld's Country Park. <br /> <br />City Attorney Goodrich stated that the purchase agreement on this property was contingent upon <br />the City's final approval of the Apple Ridge subdivision and if that approval was not granted <br />prior to September 1, 1997, the agreement was null and void.
