Case #1:

Request to Vacate a Portion of Wille mite Street

City Engineer Jankowski stated on June 4,2007 staff received a letter dated May 30,2007 from
Mrs. Linda Stenquist property owner at 15240 Willemite Street petitioning the City for the
vacation of a cul-de-sac which was platted in 1972 as a part of the Greenland Hills subdivision
but was never constructed. This street does not require a cul-de-sac since Willemite Street
intersects with 152nd Lane.

Councilmember Dehen arrived at 5:35 p.m.

City Engineer Jankowski stated staff would have no objection to the vacation of a portion of the
cul-de-sac. However, it will be necessary to retain at least a 66 foot right-of-way through the
Willemite/152nd Lane comer alignment. In addition, the current Capital Improvement Plan (CIP)
anticipates the realignment of VariolitelUranimite Street as a collector street into the Town
Center. Included in the Committee's packet is an excerpt from the CIP showing this anticipated
collector street. Since no detailed design work for this alignment has been prepared at this time,
staff would point out that it maybe advisable to retain the easternmost 40 feet of this dedicated
right-of-way in the event that the centerline of the final alignment would shift to the section line.
Mr. Jankowski stated Ms. Stenquist was sent notice that this would be discussed this evening.
He advised staff recommends the cross hatched portion of the Willemite Street cul-de-sac as
identified on the figure entitled "Cul-de-Sac Petitioned for Vacation" be recommended by the
Committee to the City Council for vacation and that staff be directed to initiate vacation
procedures for this portion of right-of-way

Chairperson Elvig requested clarification that the City may want to hold onto the easternmost 40
feet of right-of-way.

City Engineer Jankowski replied yes, at least until the alignment for the street connection is
nailed down.

Chairperson Elvig askedifthe property owner is considering doing any building.

City Engineer Jankowski replied Ms. Stenquist has said they are looking at putting in some sort
of workshop. He does not know the exact location. He can contact her after the meeting and
arrange to meet and show what is planned to see if it works for them.

Public Works Director Olson stated even keeping the 40 feet is a stretch. Staff discussed the
possibility of connection options and/or buying properties west of the alignment, knowing there
will be concerned residents when the City pushes a larger volume road through and eliminates
accesses. However, they are not quite there yet, and he thinks this would be a safe thing to
vacate the portion that has been shown until a point in time that this alignment gets finalized.

Motion by Councilmember Olson, seconded by Chairperson Dehen, to recommend to City
Council that the cross hatched portion of the Willemite Street cul-de-sac as identified on the
figure entitled "Cul-de-Sac Petitioned for Vacation" be recommended for vacation, and that staff
be directed to initiate vacation procedures for this portion of right of way.

Public Works Committee / June 19,2007
