<br />Board Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-08- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME <br /> <br />WHEREAS, Chad Weich ("Permittee") has properly applied for a variance from the <br />requirement for all newly created lots in the Metropolitan Urban Service Area (1v1USA) be served <br />by City sewer and water (Section 9.20.11 Subd. 1), in order to construct a dwelling with a septic <br />system on the prop'erty legally described as follows: <br /> <br />Outlot A, Alpaca Estates 3rd Addition, subject to easement of record, Anoka County, <br />Minnesota <br /> <br />("Subject Property") <br /> <br />WHEREAS, the Board of Adjustment met on August 2, 2007, conducted the public <br />hearing and adopted fmdings of fact related to the request for variance. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJlJSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact # _, a variance from requirement for all newly created lots in <br />the Metropolitan Urban Service Area (1v1USA) be served by City sewer' and water (Section <br />9.20.11 Subd. 1) in order to construct a dwelling on the Subject Property with a septic system <br />is hereby granted contingent upon the Permittee providing the City with the following: <br /> <br />a. Documentation that the site 'can support and primary and secondary septic system. <br /> <br />2. This variance shall automatically expire if it is not initiated within 12 months of the date of <br />issuance of an access permit from the Anoka County Highway Department. Application for a <br />building permit shall constitute initiation. The Permittee may petition for an extension of <br />time in which to complete the variance. Such extension shall be requested in writing and <br />filed with the City at least 30 days before the expiration ofthe original variance. <br /> <br />3. The Subject Property is eligible for building permits for one dwelling unit and related <br />accessory structures in accordance with City Code. The dwelling unit shall be no closer to the <br />river than the adjacent house to the east of the Subject Property. <br /> <br />4. The Permittee agrees that this variance shall be recorded in the office of the Anoka County <br />Recorder. <br /> <br />5. The Permittee shall be responsible for all City costs incurred in administering and enforcing <br />this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />10 <br />
