<br />NOW THEREFORE, BE. IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />1. Based on Findings of Fact #0_, a variance is hereby granted to the 60-foot bufferyard <br />requirement and 20-foot pavement setback, as established in Section 9.20.24 of the <br />Ramsey City Code, to allow a 30-foot bufferyard to be constructed along the northern <br />property line of the Subject Property, and a 3-5-foot setback from the right-of-way of the <br />cul-de-sac of 148th Avenue NW, to be constructed by the Applicant as part of the plat of <br />Regency Pond 4th Addition. <br /> <br />2. The Permittee shall construct the bufferyard and other improvements per the approved <br />Site Plan and plat of Regency Pond 4th Addition and to the City's specifications. <br /> <br />3. This variance shall automatically expire if it is not initiated within 12 months of the date <br />of issuance of an access permit from the Anoka County Highway Department. <br />Application for a building permit shall constitute initiation. The Permittee may petition <br />for an extension of time in which to complete the variance. Such extension shall be <br />requested in writing and filed with the City at least 30 days before the expiration of the <br />original variance. <br /> <br />4. The Permittee agrees that this variance shall be recorded in the office of the Anoka <br />County Recorder. <br /> <br />5. The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />Whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this <br />the 2nd day of August, 2007. <br /> <br />TSM Development, Inc. hereby acknowledges receipt of this variance and has reviewed the terms <br />of the variance and has agreed to comply with the terms of the variance. <br /> <br />Resolution #07-08-_ <br />Page 2 of 3 <br /> <br />33 <br />
