Absent: Board Members Holland and Jensen. <br /> <br />PUBLIC HEARINGS <br /> <br />Chairperson Deemer adjourned the regular Board of Adjustment meeting at 8:07 p.m. in order to <br />conduct the following public hearing: <br /> <br />1) Request for a Variance to Rear Yard Setback Requirements; Case ofBlatzJMach 5 <br /> <br />Chairperson Deemer called the regular Board of Adjustment meeting back to order at 8:08 p.m. <br /> <br />Case#I: Request for a Variance to Rear Yard Setback Requirements; Case of <br /> Blatz/Mach 5 <br /> <br />Zoning Administrator Frolik indicated 7105 State Highway #10 NW is a limited sized parcel which <br />barely meets lot requirements. She stated construction of the proposed accessory building on the <br />southwest portion of the lot to meet rear yard setback requirements would deplete the required off- <br />street parking currently provided on site. <br /> <br />Randy Barrows, the applicant, stated the lot is very small and he is attempting to achieve the most <br />efficient use of the land while also achieving the appropriate appearance for the State Highway #10 <br />corridor. He said due to the shortness of the lot, if the building is not positioned in the requested <br />location them will be drainage issues with the neighboring lot. He advised the back portion of the <br />lot is equipped with a pond and a swale to properly handle drainage for the proposed site location. <br /> <br />Chairperson Deemer suggested the accessory building could be located in an alternate location which <br />would be within the setbacks. He indicated drainage on the lot was constructed during the summer <br />in avoidance of City code and said a variance was being requested in order for the accessory building <br />to be located on a previously poured concrete slab. <br /> <br />Mr. Barrows stated his lot was the only business along State Highway #10 attempting to improve <br />their lot with blacktop; and once the blacktop was installed, proper drainage was needed. <br /> <br />Motion by Board Member Bawden, seconded by Board Member Thorud, to amend the findings to <br />the affirmative. <br /> <br />Motion carried: Voting Yes: Board Members Bawden, Thorud, LaDue, and Terry. Voting No: <br />Chairperson Deemer. Absent: Board Members Holland and Jensen. <br /> <br />Motion by Board Member Bawden, seconded by Board Member Thorud, to adopt Resolution #97- <br />11-320 adopting Findings of Fact #0447 relating to a request for a variance from rear yard setback <br />requirements at 7105 State Highway #10 NW. <br /> <br />Board of Adjustment/November 4, 1997 <br /> Page 2 of 3 <br /> <br /> <br />
