<br />justification. He believes the PUD is appropriate for this site. He does not know that he sides <br />with the preliminary plat that has been presented for this site, but the concept of a PUD for this <br />site is essentially for the benefits they will receive. This is a very challenged site for access, and <br />a trail needs to be accommodated. The PUD may not give the applicant what is being requested, <br />which is the ability for five units. He does not see any way around a four unit development with <br />proper site access off a high traffic, high speed county road, and allowing for a trail system that is <br />needed. He may not support the plat that has been presented, but he believes the PUD is <br />appropriate. Commissioner Brauer stated he thinks this could be accomplished under the <br />existing R -1 zoning. He is worried about setting a precedent and seeing more of this in the City <br />as pieces of land become less valuable as R-l due to the market. Commissioner Trites Rolle <br />indicated this is another good situation to review with the Comprehensive Plan review. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Van Scoy, Cleveland, <br />Hunt, and Trites Rolle. Voting No: Commissioner Brauer. Absent: None. <br /> <br />Case #8 <br /> <br />Public Hearing - Request for Preliminary Plat of Bridgewater; Case of CBR <br />Development <br /> <br />Chairperson Nixt indicated the record should reflect that the public hearing and discussion for <br />Case Nos. 7 and 8 were handled together. <br /> <br />Motion by Commissioner Van Scoy, seconded by Commissioner Hunt, to recommend that the <br />City Council approve the preliminary plat for Bridgewater; Case of CBR Development, <br />contingent on the City Staff Review Letter dated June 1,2007, and contingent on incorporating <br />the trail corridor within the right-of-way. . <br /> <br />Further discussion: Commissioner Hunt pointed out that according to the map, all of the lots <br />down to Lord of Life Church are existing, and there will not be a trail put on the private lots. <br />There is no more development of private lots along Nowthen Boulevard, so every part of the trail <br />with the exception of this lot will be on the highway right-of-way. Requiring the trail to be on <br />private property within this subdivision does not make any sense. Chairperson Nixt replied this <br />comment is logical, but they do not have the wisdom of staff as to whether the City would <br />exercise its condemnation authority for public use for this trail. However, he doubts this would <br />be done for a bituminous path. Commissioner Cleveland pointed out there has also been <br />discussion about the extension of Nowthen Boulevard into a four lane highway. Commissioner <br />Van Scoy inquired about the plan for the trail. City Engineer Jankowski indicated the trail will <br />be within the right-of-way on the east side of Nowthen Boulevard; it will likely be one foot off <br />the east right-of-way line. It is intended that this will be accomplished before school opens in the <br />fall. Commissioner Brauer noted if the trail were to be included in the plat all five of the lots <br />would be nonconforming. <br /> <br />Motion failed. Voting Yes: Commissioners Van Scoy, Hunt, and Cleveland. Voting No: <br />Chairperson Nixt, Commissioners Brauer and Levine.
