<br />Board Member Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-06-133 <br /> <br />A RESOLUTION DENYING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br />WHEREAS, T -Mobile USA, hereinafter referred to as "Permittee," has properly applied <br />for a variance from Section 9.15.07 regarding the rear yard setback for the telecommunications <br />tower proposed at Alpine Park, legally described as follows: <br /> <br />Lot 1, Block 1, ALPINE PARK <br /> <br />(the "Subject Property") <br /> <br />WHEREAS, the Board of Adjustment met on June 7, 2007, conducted the public hearing <br />and adopted findings of fact relating to the request for a variance from rear yard setbacks, <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact #0794, a variance is hereby denied to rear yard setback for the <br />construction of a telecommunications tower in Alpine Park, as established in Section <br />9.15.08 of the Ramsey City Code, to install a tower compound at a zero-foot setback, <br />with a tower setback of 20 feet from the shared property line with Waste Management. <br /> <br />2. The Permittee shall revise the plans to conform with the rear yard setbacks. <br /> <br />3. The Permittee shall be responsible for all City costs incurred in processing the variance <br />request. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Levine, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Van Scoy <br />Board Member Nixt <br />Board Member Levine <br />Board Member Brauer <br />Board Member Cleveland <br />Board Member Hunt <br />Board Member Trites Rolle <br /> <br />and the following voted against the same: <br /> <br />None <br />
