Absent None. <br /> <br />Motion by Board Member Nixt, seconded by Board Member Levine, to deny the request from T- <br />Mobile for a variance from rear yard setback standard for a telecommunications tower in Alpine <br />Park based on the findings offact, and adopt Resolution #07-06-133 declaring terms of same. <br /> <br />Motion Carried. Voting Yes: Chairperson Van Scoy, Board Members Nixt, Levine, Brauer, <br />Cleveland, Hunt, and Trites Rolle. Voting No: None. Absent: None. <br /> <br />Case #2: <br /> <br />Public Hearing - Request for a Variance from Maximum Front Yard Setback <br />from Street Right-of-Way for the Anoka County Medical Examiner Facility <br />in Town Center; Case of PSD, LLC, and Anoka County <br /> <br />Chairperson Van Scoy closed the regular portion of the Board of Adjustment meeting at 8:14 <br />p.m. in order to conduct the public hearing. <br /> <br />Public Hearin2 <br /> <br />Chairperson Van Scoy called the public hearing to order at 8:14 p.m. <br /> <br />Presentation <br /> <br />Assistant Community Development Director Frolik advised based on the approval of the site <br />plan under Case No. 2 of the Planning Commission meeting, staff recommends approval of the <br />variance request. <br /> <br />Board Member Nixt noted that the applicant has used architectural features and landscaping to <br />give the illusion that the building is out to the street. He indicated he is comfortable with the <br />variance because the applicant has made every reasonable attempt to comply with the intent of <br />the ordinance. He requested verification from staff that the findings of fact adequately reflect the <br />applicant's design features. <br /> <br />Assistant Community Development Director Frolik responded in the affirmative. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Board Member Nixt, seconded by Board Member Levine, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Van Scoy, Board Members Nixt, Levine, Brauer, <br />Cleveland, Hunt, and Trites Rolle. Voting No: None.
