No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the <br />lot is provided including the installation of at least one layer of bituminous surfacing; (b) <br />both the sanitary sewer and water utilities are in place, fully operational, and accepted by the <br />CITY; (c) for lots that have a slope of less than 2 %, a certificate of grading, prepared by a <br />licensed (State of Minnesota), professional land surveyor, must be provided to the City <br />documenting that the flattest grade on this lot is 1% or greater will require certificates of <br />grading; and (d) boulevard sod and landscape trees, or escrow for same, have been provided <br />(see Paragraph 20 below). . <br />SECTION IV <br />PARK DEDICATION <br />16. Park Dedication. The.GAD's Prairie Plat is located in the Sunfish Lake Recreation District. <br />Park dedication requirements shall be satisfied by a cash payment of Two Thousand Four <br />Hundred Seventy Five Dollars and no cents ($2,475.00) per lot. The Plat is creating 7 lots, <br />therefore the cash payment due on the Plat is Seventeen Thousand Three- Hundred, Twenty- <br />Five Dollars and no cents ($17,325.00). This payment shall be made to the City prior to the <br />release of the Final Plat for recording. <br />SECTION V <br />TRANSPORTATION AND LANDSCAPING <br />17. Future Access. Upon completion of Helium Street to 146 Avenue in the future, the access <br />onto County Road 5 shall be removed, and all access to this development shall be gained <br />from 146 Avenue. Right of way has been provided to accommodate a cul -de -sac on the <br />southern edge of the plat. <br />1 8. Trail Development and Fees. The 2007 Trail Development Fee is Six Hundred Dollars and <br />no cents ($600.00) per unit. Therefore, a payment in the amount of Four Thousand, Two - <br />Hundred Dollars and no cents ($4,200.00) shall be paid to the CITY prior to releasing the <br />Plat for recording. <br />19. Trail Construction. In accordance with the approved grading plan, a 10 -foot, bituminous <br />trail shall be constructed along the eastern edge of the property, within the boundaries of the <br />Plat, where specified, and in the right -of -way on the north end of the property, as indicated <br />on the grading plan dated April 27, 2007. <br />20. Tree, Shrub and Sod Planting Plan. The addition of trees, shrubs and sod to the Plat shall <br />be in accordance with the approved Landscape Plan and Tree Inventory prepared by <br />Hakanson Anderson, dated April 27, 2007. The trees to be protected during construction must <br />be identified on the grading plan, and the plan must require the installation of `tree save <br />fences' prior to land clearing or grading.
