Community Development Director Trudgeon indicated there is an easement that would be
platted as right-of-way. A variance would be needed to go in 1,300 feet. Under City Code the
developer could go 600 feet in without a variance so in theory three lots could be constructed.

Ms. Wald verified with Mr. Trudgeon that no matter what is done with the property there will be
a public street at the end and a variance will be needed. She stated Shade Tree is willing to work
with the City on anything; they just want to get something going.

Community Development Director Trudgeon indicated there has been a lot of neighborhood
involvement regarding this property. One concern with the past plan was traffic, and he does not
think a single access would be supported.

Councilmember Look asked whether staff might contact the property owner concerning the
completion of the road;

Community Development Director Trudgeon indicated staff could contact Mr. Longfield again
regarding the new discussions for this property.

Ms. Wald suggested it would be better for the developer to contact the landowner first.

Councilmember Dehen asked what the landowner's position has been in the past.

Community Development Director Trudgeon replied he was willing to look at it at first, but by
the end of the process he was not in favor of working with the developer to make the road
happen.

Councilmember Look asked if there is a house on that property.

Community Development Director Trudgeon replied there are two; a road would not affect the
structures.

The Council expressed a willingness to consider allowing the developer to phase In the
development in order to work on the access requirements.

Mayor Gamec indicated the entire development would still need to be platted if phasing is
allowed.

Councilmember Strommen stated she would like to know if the developer is able to make contact
regarding the access and how that is going. There would need to be headway being made before
she would agree to phasing the development.

2) Concept Plan for NE Corner of Bunker Lake Blvd and Ramsey Blvd _ TSM
Development

Associate Planner Geisler stated Steve Schmitt of TSM Development has submitted a new
concept plan for development of the northeast comer of Bunker Lake and Ramsey Boulevards.

City Council Work Session / July 24, 2007
Page 4 of6
