<br />9. That the Subject Property is approximately 1.5 acres in size and 105 feet wide at the street. <br /> <br />10. That Section 9.20.11 of the Ramsey City Code states that all newly created lots, except the <br />remnant of a lot of record not less than five (5) acres in size and located within the 2020 <br />MUSA, shall be serviced by sanitary sewer and municipal water. <br /> <br />11. That the Applicant is proposing to construct a single family dwelling on the Subject Property, <br />to be served by a septic system. <br /> <br />12. That on August 2, 2007 the Board of Adjustment denied the variance request, because City <br />Code is clear on the need for sewer and water for newly created lots in the MUSA. <br /> <br />13. That the Applicant submitted an appeal of the Board's decision on August 6, 2007 in <br />accordance with City Code requirements. <br /> <br />14. That on August 23, 2007 Staff received written comments from the DNR stating that they do <br />not recommend approval of the proposed subdivision because the lot will not be connected to <br />City sewer and water. <br /> <br />15. That the variance requested is/is not the minimum variance which would alleviate the <br />hardship. <br /> <br />16. That the special conditions associated with the variance request do/do not result from the <br />actions of the Applicant. <br /> <br />17. That if granted, the variance will/will not permit a use that is prohibited in the R-1 :MUSA <br />District. <br /> <br />18. That the granting of the variance will/will not grant the Applicant any special privileges that <br />are denied by this Chapter to other owners of land in the same district. <br /> <br />19. That if granted, the variance will/will not impair an adequate supply of light and air to <br />adjacent property. <br /> <br />20. That if granted, the variance will/will not be materially detrimental to the purposes of this <br />Chapter or other property in the same zone. <br /> <br />21. That if granted, the variance will/will not increase the danger of fire, or endanger the public <br />safety . <br /> <br />22.
