<br />Council Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-08- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME <br /> <br />\VHEREAS, Chad Wiech ("Permittee") has properly applied for an appeal of denial of <br />his variance request by the Board of Adjustment on August 2, 2007. The variance is requested to <br />the requirement for all newly created lots in the Metropolitan Urban Service Area (MUSA) to be <br />served by City sewer and water (Section 9.20.11 Subd. 1), in order to construct a dwelling with a <br />septic system on the property legally described as follows: <br /> <br />Outlot A, Alpaca Estates 3rd Addition, subject to easement of record, Anoka County, <br />Minnesota <br /> <br />("Subject Property") <br /> <br />WHEREAS, the Board of Adjustment met on August 2, 2007, conducted the public <br />hearing, adopted fmdings of fact, and denied the variance request., <br /> <br />WHEREAS, on August 6, 2007 the Permittee submitted a written appeal of the Board of <br />Adjustment's denial of his variance request. <br /> <br />WHEREAS, on August 28, 2007 the City Council heard his appeal request and adopted <br />findings of fact. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact # _, a variance from the requirement for all newly created lots <br />in the Metropolitan Urban Service Area (MUSA) be served by City sewer and water (Section <br />9.20.11 Subd. 1) in order to construct a dwelling on the Subj ect Property with a septic system <br />is hereby granted contingent upon the Permittee providing the City with the following: <br /> <br />a. Documentation that the site can support a primary and secondary septic system. <br /> <br />2. This variance shall automatically expire if it is not initiated within 12 months of the date of <br />issuance. Application for a building permit shall constitute initiation. The Permittee may <br />petition for an extension of time in which to complete the variance. Such extension shall be <br />requested in writing and filed with the City at least 30 days before the expiration of the <br />original variance. <br /> <br />3. The Subject Property is eligible for building permits for one dwelling unit and related <br />accessory structures in accordance with City Code. The dwelling unit shall be no closer to the <br />river than the adjacent house to the east of the Subject Property. <br /> <br /> <br />-192- <br /> <br />- <br />
