Ms. Abendroth questioned what the situation will be if this business fails.

Councilmember Strommen explained the property is still zoned residential.

Community Development Director Trudgeon indicated there would likely be interest 111
something being done on the site. Any requests would need to be considered at that time.

Councilmember Lookinquired about the timeframe on the conditional use permit.

Community Development Director Trudgeon indicated there is not an expiration date on the
pem1it.

Councilmember Look stated he understands that the 91 children is full capacity for the daycare,
whether or not that is achieved. He would be interested in reviewing this to determine whether
or not there is a conflict created with the neighborhood with things like traffic, etc.

COUl1cilmember Strommen questioned if there is an ability to consider the daycare, as it is
already allowed under the original conditional use permit.

COl1U11Unity Development Director Trudgeon advised the applicant is stating they would like an
amendment to the pennit. In consideration of that the Council may want to include some
stipulations on that. His understanding is that the Council would like an opportunity to review
this if it becomes a dangerous situation.

Councilmember Look indicated he does not think the deli will cause problems, but the kids may.
Once this is on the ground running and they see how things like the traffic flow works, they may
want the flexibility to work it to a more acceptable situation.

Council member Dehen expressed cone em regarding the possibility of the applicant investing
time and money into the site and the City pulling the rug out from under them in five years if
they do not like the traffic flow.

Mayor Gamec pointed out that daycares are inspected and well regulated by the County and
State, and those regulations would detennine the number of children that would be allowed.

Councilmember Olson stated the Council is dealing with the deli tonight; the daycare has already
been dealt with. Any corllinents relating to the daycare are really a moot point because that was
passed a long tin1e ago. The Council needs to focus on the del,i.

Ms. Lublin stated when she bought the property almost 16 years ago; Mr. and Mrs. Abendroth
were the people against it. It did pass, and it was a perpetual agreement that they would be able
to expand to 2,200 square feet of professional space, and the City Council at that time wanted a
day care. After she bought the property she had it surveyed and fOUl1d out that the Abendroth's
driveway tum out was on her property, and they could not really get into their garage without
that. The Abendroth's have been paying her $30 per year to rent that to keep her property rights
established. Last SUlnn1er she approached them because she was going to go ahead with this

City Council / July 24, 2007

P51
