<br />Subd.3. In case of emergency, the Zoning ,\dministmtor or Building Official may <br />cause tl1e immediate removal of a dangerous or defective sign 'sithout notice,. Signs remo';ed in <br />tIlis manner m:.:st present a hazord to the public safety as defined in the State Building Code. <br /> <br />9.12.19 <br /> <br />Enforcement <br /> <br />Subdivision 1. Enforcement of the sign ordinance shall be conducted by the <br />Zoning Administrator and/or their assigns. Signs not complving with the sifLn <br />ordinance. as vvitnessed and documented by the Zoning Administrator. will be <br />sub;ect to the below procedure. <br /> <br />Subdivision 2. When a violation of Section 9.12.03 Subdivision 1 (Location) <br />is witnessed bv the Zoning Administrator or other law enforcement official. the City <br />reserves the rirrht to remove the sign from the public right-of-way immediatelv. <br />vvithout notice. The siQl1 Vlill subsequently be discarded. <br /> <br />Sllbdh'ision 3. \\7hen a violation of any other provision ofthis ordinance has <br />been vvitnessed. the folloVv1.nrr actions will be taken bv the City: <br /> <br />a. \Vritten Notice. Written notice will be made that the property owner IS ill <br />violation of the siQl1 ordinance. and 5 business days will be given for cOlTective <br />action. <br /> <br />b. Notice of abatement or issuance of administratj"e citation. After the 5 <br />business days have passed. if the sign remains. the City will follow with an <br />administrative citation and/or a notice of commene-ementof abatement <br />proe-edures. in accordance \vith Section 5.19 Enforc.ement and Penalties <br />ft;- <br /> <br />Notice <br /> <br />Subdivision 4. The owner of the parcd upon "\vhich the siQl1 is located shall <br />be presumed to be the owner of all signs thereon unless facts to the contrary are brought to the <br />attention of the Zoning Administrator. <br /> <br />Subdivision 5. In case of emergency. the ZoIiing Administrator or Building <br />Official may cause the immediate remoyal of a danl2;erous or defee-tive sign Vlithout notice. To provide for a reasonable interpretation of the prOVISIOns of this <br />Ordinance, a permit applicant who wishes to appeal an interpretation by the Zoning Administrator <br />may file a written appeal with the City Administrator and request a hearing before the City <br /> <br />68 <br />
