<br />CASE # ~ <br /> <br />PUBLIC HEARING <br />PROPOSED ORDINANCE TO AMEND <br />OFF-STREET PARKlNG REGULATIONS IN RAMSEY CITY CODE; <br />CASE OF CITY OF RAMSEY <br />By: Sylvia Frolik, Asst. Community Development Director <br /> <br />Background: <br /> <br />The significant majority of the code enforcement cases processed by the City relate to junk <br />vehicles. Currently City Code does not place any restrictions on the number of vehicles that can <br />be stored outside on a residential parcel; only that the vehicle must be operable and all but one <br />must be licensed. The City's legal counsel has made it known that regulating outside storage of <br />vehicles and equipment by whether or not they are operable is very difficult. When these types <br />of cases get into the court system, the judges generally place the burden of proof of 'inoperable' <br />on the City. If the property owner is not cooperative with the City's request for proof of <br />operability, then the City fails to make its case unless a warrant is sought. Legal counsel has <br />indicated that the City would be better able to control outside storage of vehicles if it were based <br />on numbers of vehicles as well.as operable arid licensed. <br /> <br />On July 10, 2007, the City Council directed City Staff to draft an ordinance amendment that <br />would establish limits on the number of vehicles and equipment parked and stored outside on <br />residential parcels. <br /> <br />Notification: <br /> <br />The public hearing notice regarding the proposed ordinance to amend off-street parking <br />regulations in the residential zones was p1+blished in the City's official newspaper. The proposed <br />ordinance was also noted in the August/September Ramsey Resident newsletter. <br /> <br />Observations: <br /> <br />City Staff has drafted the enclosed ordinance amendment to restrict the number of vehicles and <br />recreational equipment stored outside on residential parcels as follows: <br /> <br />. 1 licensed vehicle per licensed driver in household <br />. 2 additional licensed vehicles per household <br />. 2 major pieces of appropriately licensed recreational equipment (Le. R.V., Camper, Boat, <br />etc.), <br />. 1 licensed collector or classic vehicle <br /> <br />The current parking surface standards (Class 5 or con-bit outside the urban service area and <br />bituminous or concrete inside the urban service area) will be retained in the Code. <br /> <br />91 <br /> <br />
