CASE # \

PUBLIC HEARING
REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY
BUILDING NEARER THE FRONT PROPERTY LINE THAN THE
PRINCIPAL BUILDING; CASE OF DONALD HASSLER
By: Amy Geisler, AICP, Associate Planner

Background:

Section 9.11.02 of the Ramsey City Code states that on properties less than two (2) acres in size,
no accessory building shall be constructed nearer the front property line than the principal
building. Mr. Hassler has applied for a variance to constnict an accessory building nearer the
front property line than his home on the property located at 6660 13 7th Avenue NW.

The following items are included for your information:

a) Site location map
b) Site drawing
c) Proposed Findings of Fact
d) Proposed Variance

Notification:

In accordance with State Statute, Staff sent notification to property owners within 350 feet of the
subject property of the request for a variance.

Observations:

. The subject property is about 0.7 acres and thus, City Code requires any detached accessory
building to be constructed in the side or rear yard. The property is located on the Mississippi
River and must also meet additional setback requirements related to the river overlay district.

The applicant's home was built in the 1930s and is approximately 75 feet from the river. An
existing detached garage is located between thehome and 137th Avenue, which was damagedby
fire several years ago. Mr. Hassler wishes to tear this one down and build a new garage, slightly
south of the existing garage but still between the house and the street, which requires a variance.
The existing garage is approximately 20 feet from the front property line and is considered legal
non-conforming.

When constructed, the new garage would be 162 feet from the river, 30 feet from the front
property line, and 10 feet from the side property line. The new garage will meet the river setback
requirement of 100 feet. The garage will be 676 square feet in size, also meeting the size
requirements of City Code.

1
