<br />Funding Source: <br /> <br />The Developer is responsible for all costs associated with processing the land use <br />application and the development. <br /> <br />Staff Recommendation: <br /> <br />Staff is concerned with the impacts that the County Road improvements will have on a <br />retail-type activity. The City Council has heard the negative impacts that the installation <br />of raised medians can have on retail uses in the discussion about Sunfish Commons and <br />the retail at Bunker Lake Boulevard and TH 47. However, the County's requirement to <br />install right-inlright-out only turning movements on both accesses will provide a <br />reasonable expectation to any user of the property. <br /> <br />The Planning Commission conducted a public hearing on August 2, 2007, and <br />recommended approval of the zoning amendment. The majority of the discussion was <br />around the future raised medians and that impact on surrounding businesses and <br />industrial uses. <br /> <br />In general, the City Council has expressed that B-1 Business uses are appropriate at this <br />location, depending on the specific project. Therefore, staff recommends approval of the <br />zoning amendment from E-l Employment to B-1 Business, contingent upon development. <br />in accordance with an approved site plan and installation of right-inJright-out only <br />configurations at both access points. <br /> <br />Council Action: <br /> <br />Motion to adopt Findings of Fact relating to a request from the applicant to rezone the <br />property described as Lot 1, Block 1, Gateway North Industrial Park No.3 (Outlot A and <br />Lot 1, Block 1, Sunfish Lake Development) from E-1 Employment to B-1 Business; <br /> <br />-and- <br /> <br />Motion to introduce an ordinance to rezone Lot 1, Block 1, Gateway North Industrial <br />Park No.3 (or upon recording, Outlot A and Lot 1, Block 1, Sunfish Lake Development) <br />from E-l Employment to B-1 Business, contingent upon Met Council approval of the <br />land use change and developing the property in accordance with an approved site plan, <br /> <br />-or- <br /> <br />Motion to recommend denial of the rezoning, based on the findings of fact. <br /> <br />Review Checklist: <br />Assistant Community Development Director <br />City Engineer <br /> <br />cc: 9.11.07 <br /> <br />-138- <br /> <br />. <br />
