<br />CASE #: <br /> <br />b <br /> <br />REQUEST FOR PRELIMINARY PLAT APPROVAL OF BRIDGEWATER; <br />CASE OF CBR DEVELOPMENT <br />By: Breanne DaInes, Associate Planner <br /> <br />Background: <br /> <br />Torn Rollings submitted a preliminary plat application to develop 5 single family lots on an <br />approximately 1.5 net acre parcel located generally on the east side of Nowthen Boulevard, .north <br />of Sun wood Drive, at 14765 Nowthen Boulevard. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Preliminary Plat <br />c) City Council minutes from June 26, 2007 <br />d) Proposed Findings . <br /> <br />Notification: <br /> <br />In accordance with City Code, Staff attempted to notifY property owners within 700 feet of the <br />subject property for the public hearing atthe Planning Commission on June 7, 2007. <br /> <br />Observations: <br /> <br />The applicant is seeking to develop a 1.5 net acre parcel on Nowthen Boulevard with 5 single <br />family lots. The property is currently zoned R-l Residential and is guided low density residential <br />by the Comprehensive Plan. <br /> <br />The maximum density in the R-l Residential (MUSA) district is 3 units per net acre. The plat is <br />proposing 3.3 units per acre, which exceeds the maximum. Also, the proposed plat does not meet <br />all setback requirements set forth in the R-l district, resulting in a minor deviation to two front <br />yard setbacks. Lastly, 3 of the 5 lots are deficient of the lot width requirement of 80 feet at <br />building setback line (for cul-de-sac lots). <br /> <br />A zoning amendment to planned-unit-development was denied for this site, and therefore the plat <br />does not conform to the City Code for development in the R-I Residential district with regard to <br />density or setbacks. <br /> <br />Funding Source: <br /> <br />The Developer is responsible for all costs associated with processing the land use application and <br />the development. <br /> <br />Staff Recommendation: <br /> <br />Staff recommends denial of the plat, due to its non-conformance with City Code, specifically <br />Section 9.20.11, subdivision 4. <br /> <br />-181- <br />
