recommends retaining the basic current language in Section 8.30.08 'and 8.30.09 with <br />modifications because it is more detailed than the proposed language. <br /> <br />Wetland setback. Section 5.11 C. contains an ISTS setback from non-protected water wetlands. <br />This is an optional setback not required by the rules. Staff recommends against incorporating <br />this language in the ordinance. <br /> <br />Maintenance. Section 5.12 contains the rule language for required maintenance on a tank. The <br />rule only requires that the scum and sludge be measured or removed at least every three years. <br />A local ordinance may set more frequent maintenance requirements, pumping and not just <br />measuring, reporting to the City of maintenance activity or any other more restrictive <br />maintenance program the City may desire. Staff is recommending adopting the language <br />proposed by M.P.C.A. This is a reduction in what our current policies require. The pumper <br />would no longer need to report pumpings to the City. <br /> <br />Alternative and Experimental Systems. If a local government wants to allow alternative or <br />experimental systems in their jurisdiction, they must adopt Chapter 7080.0910. Language to <br />adopt that section is covered in Section 5.13. Staff is recommending against inclusion of this <br />wording as there appears to be little need for such systems in Ramsey. <br /> <br />Land application of septage. The rule requires that septage be applied according to federal, state <br />and local requirements. This model has language that would have the local government review <br />land application of septage proposals and sets separation distances for spreading in accordance <br />with M.P.C.A. and EPA guidelines, and prohibits spreading of septage in Shoreland <br />Management Areas (Shoreland zoning district). The language for this is contained in sections <br />2.31 B and 5.2. Staff is recommending against inclusion of this wording as there is little need <br />for land application of septage in Ramsey due to the availability of dumping stations. <br /> <br />Committee Action: <br /> <br />Review draft ordinance and provide direction on the recommendations listed above.
