<br />Mr. Steven WilI, 8144 144th Avenue, asked if the Commission is leaning toward granting a variance <br />solely because sewer and water is not readily available. <br /> <br />Chairperson Van Scoy stated they have not indicated towards one preference or another, staffhas <br />made a recommendation for this. <br /> <br />Mr. Will asked if the recommendation was for this because sewer and water was not readily <br />available. <br /> <br />Chairperson VanScoy believed that to be true. <br /> <br />Mr. Will asked what the minimum land requirements are to meet the septic rules. <br /> <br />City Engineer Jankowski stated the property must meet the requirements of State Statue 7080, <br />which is the septic system code. It relates to separation distances and does not have a minimum lot <br />size limit on it. <br /> <br />City Engineer Jankowski stated that was correct and from a property line it has to be ten feet. He <br />stated there has to be a 50 foot separation from the septic system to the well as well. He stated the <br />applicant has had a soil report done which shows that there are soils onsite that can sustain a <br />standard drain field but the report concludes that further investigation is required on the parcel upon <br />site selection for the house. He noted he talked to the person who wrote the report asking if there <br />was adequate room on this parcel for a septic along with a house and the response was that there <br />was adequate room. <br /> <br />Board Member Nixt asked if an official perk test has been done. <br /> <br />City Engineer Jankowski indicated there have been soil pits dug by a certified soil scientist. <br /> <br />Board Member Nixt asked what the setback was for the drain field from the ordinary high water <br />mark. <br /> <br />Associate Planner DaInes indicated it is seventy-five feet. <br /> <br />Mr. Will asked what the schedule was for making a decision on the variance. <br /> <br />Board Member Nixt stated they have the ability to make the decision tonight. <br /> <br />Mr. Will stated if the variance is not granted, does the piece of land become unbuildable. He <br />wondered who the current fee owner is. <br /> <br />Associate Planner DaInes indicated Mr. Chad Wiech is the fee owner. <br /> <br />Mr. Will stated the neighbors want to make sure everything is sorted out before a decision is made. <br />The concern of the neighborhood is to take a small acreage development that has standards and <br />break away from that and he thought everyone was concerned about that and that a precedent will be <br /> <br />Board of Adjustment/August 2,2007 <br />Page 4 of 12 <br />
