Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Jeffrey, Dehen, Look,
Olson, and Strommen. Voting No; None.

Further discussion: Council member Elvig requested clarification that this will be a minor
change from Employment to Business zoning. Community Development Director Trudgeon
replied yes, Employment Business is more industrial and the rezoning to B-1 Business will be
more retail/commercial. Council member Elvig commented this rezoning is more conducive to
what they are trying to do here. Councilmember Dehen asked why this is being done in a
piecemeal fashion. Community Development Director Trudgeon replied it could have been done
either way. Some of these things were in the process and it was determined that other things
needed to happen. The entire site will not be ready to be taken totally under consideration until
later in September. Mr. Schmidt stated until about one year ago the properties had separate
ownership. When he acquired the comer parcel it was as commercial property, so he is a little
befuddled; it appear that the Comprehensive Plan Amendment was completed and not the
rezoning. He stated Sylvia Frolik called and asked if he would agree to the rezoning to comply
with the Comprehensive Plan Amendment. He thought they should straighten the whole thing
out, and came forward with a plat for that. Another reason for the delay is that when he received
the original approval he was required to give a 40 by 60 foot piece of land to the south parcel for
access because that access was being taken away by the County. He ended up acquiring the
property, and it now makes sense to make them all commercial with the south three lots.

Case #3:

Request for Final Plat Approval of Brookfield Fourth Addition; Case of
Oakwood Land Development

Community Development Director Trudgeon stated Oakwood Land Development has applied for
final plat approval to develop 15 urban single family residential lots as the fourth phase of
Brookfield Addition. The property is generally located west ofNowthen Boulevard and south of
Trott Brook. The final plat complies with the approved preliminary plat in terms of lot
standards, as outlined in the City Staff Review Letter. Staff would note that the final plat shows
one additional lot on the north side of 167th Crossing, compared to the approved preliminary plat.
Given the large size of the plat, staff does not consider this a substantial deviation from the
approved preliminary plat. Mr. Trudgeon stated the applicant received a Comprehensive Plan
Amendment for the subject property, making it eligible for connection to municipal sewer and
water. An Environmental Assessment Worksheet (EA W) was completed for the project during
the preliminary plat review. The City Council determined at that stage that the preparation of an
Environmental Impact Statement (ElS) is not required for this development.

Community Development Director Trudgeon stated the proposal for the fourth phase of
Brookfield includes the construction of 16ih Crossing and Kamacite Street. The grading and
utility plans have been reviewed and are acceptable. Some changes are needed to the
landscaping plan, primarily with regard to density transition landscaping. The preliminary plat
for Brookfield was approved with a contingency to include additional density transition
landscaping in this area. Some additional landscaping is shown on the submitted plans, but more
information is needed on the existing trees to determine if the new plantings shown are
sufficient. Mr. Trudgeon stated staff is recommending approval of the final plat. Staff is also
recommending that some additional measures be taken to insure the installation of the density

City Council / August 28, 2007
