CASE # g

REQUEST BY JAMES PROVINZINO TO PURCHASE
REMNANT PARCEL OWNED BY CITY
By: Steven Jankowski, City Engineer

Backgroun&:

Recall that at the January 16,2007 Public Works Committee meeting the City discussed a
December 21, 2006 letter from Mr. James Provinzino requesting that the City quit claim
to him a 2,022 square foot remnant parcel located between his property at 6304 Highway
10 and Riverdale Drive. This parcel was created in 1989 when Riverdale Drive was
constructed.. A copy ofMr. Provinzino's letter and a map illustrating the subject parcel
and adjacent area is attached.

The recommendation of the Committee which was ratified by the City Council was to
offer Mr. Provicino the property free of charge but retaining drainage and utility and
trail easements in favor ofthe City over the subject parcel, contingent on Mr.
Provinzino's acceptance that he will not receive compensation if and when his access to
Highway 10 is closed. Attached is a February 20, 2007 letter to Mr. Provinzino with the
above offer.

Staff received a phone call from Mr. Provinzino in July stating that the contingency
associated with the City's offer was not acceptable to him, but inquiring whether an
outright purchase of the property would be considered. Staff is seeking direction on a
response to Mr. Provinzino' s request.

Action:

Based upon discussion.

Reviewed By:
Public Works Director/Principal City Engineer
City Attorney

PW: 09/18/07

39
