<br />tonight, if they were to l~ok back and see that all of the homes were constructed and the pond <br />was operating, the City would have released the developer's funds. <br /> <br />Chairperson Elvig asked if the residents are looking for assistance from the City to help support <br />them in their quest to get the developer to repair this. He noted it looks considerably nicer with <br />the pond there than without. He is not sure what position they can take as a City. The request <br />from the residents has been received; staff will have to look through this, and possibly talk with <br />legal counsel about what type of position the City could take. He cannot imagine that the City <br />could withhold monies from the developer if they are not being held specifically for that purpose, <br />but they may be able to add some influence and can try to. help. The residents are their <br />constituents and they like to see a developer do a good job. Obviously the liner is a problem. <br /> <br />Mr. Rathburn stated the residents all have pride in their homes. The pond is now actually <br />starting to smell like a compost site. <br /> <br />Public Works Director Olson stated he understands there was a big snowfall in March, and that <br />there was some snowmelt, but there have been complaints citywide about water levels in ponds <br />and wetlands, even regarding the pond to the south of Alpine Drive that is lined also. He is not <br />saying that is the reason this pond is not full, but they have not had very good rainfall years. The <br />DNR is talking about drought conditions statewide. <br /> <br />Mr. Wagner stated when there is noticeable fluctuation it is not natural evaporation. <br /> <br />Public Works Director Olson replied yes, but the pictures from July 16th show that there is still <br />some water in the pond, although it is not high. <br /> <br />Mr. Rothburn stated the water level dropped 18 inches within a timeframe of a few days, and this <br />is a lined pond. <br /> <br />Public Works Director Olson indicated he saw the email about a potential solution for the breach. <br />Staff can do more research on this, as he has no idea on the cost. <br /> <br />Mr. Rothburn stated he is looking into this as well. The repair included in the email was used in <br />Woodbury and it sealed the liner up tight; it holds water to this day. Mr. Rothburn read a <br />notification of a wetland survey that was received by one of the neighbors. He stated he <br />understands this is not a true wetland, but it is in the rear of someone's yard. If it is was in the <br />back of any of the councilmembers' yards he doubts they would let it go. <br /> <br />Chairperson Elvig stated he appreciates the residents bringing this forward and getting this <br />documented. He would be passionate about this also. Staff will need to look into this to <br />determine how the City might be able to assist. He directed staff prepare a case on this topic to <br />be included on the next Committee meeting agenda. <br /> <br />Councilmember Dehen stated he agrees if he was living there and this happened he would not <br />like it.
