<br />Mr. Schmidt replied no, the cul-de-sac will dead-end and there will be a privacy fence. No <br />traffic will go through the neighborhood. <br /> <br />Councilmember Elvig pointed out that Mr. Ciche had said this is a quiet neighborhood with a lot <br />of kids. He asked if Mr. Schmidt sees a safety concern. <br /> <br />Mr. Schmidt replied there is no way for this property to be directly accessed by the <br />neighborhood. <br /> <br />Motion by Councilmember Look, seconded by Councilmember Dehen, to grant approval of the <br />proposed preliminary plat for Regency Pond 4th Addition contingent upon: <br />1) Compliance with the City Staff Review Letter dated July 26, 2007, revised August 23, <br />2007 <br />2) Receipt of a variance to cul-de-sac requirements <br />3) Receipt of zoning and comprehensive plan amendments. for the southern half of the <br />property <br />4) Verification of adequate drainage and utility easements during site plan review <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Look, Dehen, Elvig, Jeffrey, <br />Olson, and Strommen. Voting No: None. <br /> <br />'- . <br />;7 Case #2: Request for Zoning Amendment from E-1 Employment to B-1 Business; <br />Case of TSM Development, Inc. <br /> <br />Community Development Director Trudgeon explained this zoning amendment is being <br />processed along with the preliminary plat for Regency Pond 4th Addition. State Statute requires <br />cities to rezone property accordingly once a Comprehensive Plan Amendment has been <br />approved. Staff would note that only the two residential parcels on the comer are being rezoned <br />at this time; TSM has submitted a Comprehensive Plan Amendment and zoning amendment <br />request to also rezone the southern portion of Outlot A. These requests will be before ip.e <br />Planning Commission and City Council in September.' Mr. Trudgeon stated the Planning <br />Commission reviewed the zoning amendment at their August 2, 2007 meeting and recommended <br />approval of the zoning amendment. Staff also recommends approval of the request. The <br />Council action requested tonight is adoption of the findings of fact and introduction of the <br />ordinance to rezone the subject property from E-1 Employment to B-1 Business. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to adopt Resolution #07- <br />08-202 adoptirig Findings of Fact #0805 relating to a request from TSM Development to rezone <br />the Subject Property from E-1 Employment to B-1 Business. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Jeffrey, Dehen, Look, <br />Olson, and Strommen.
