Mr. Rothburn stated what he is looking for is a little more information with some direction, and
not just pointing fingers to have the residents deal with Arcon. If the City has funds that are
being held that is a little bit ofteeth.

Mr. Klink asked if this is considered a drainage pond or a wetland.

Public Works Director Olson replied it is considered a drainage pond. He is surprised to hear
that one ofthe residents received a wetland survey notice. The intent is to look at the wetlands in
the City; not stormwater ponds. The last thing they want is for this to be a wetland, because then
there are restrictions on it. The pond is located on a drainage and utility easement. Staff
completely understands the issue from the perspective of the residents. The City's perspective is
somewhat different in that this is an amenity that is benefiting directly adjacent properties. The
point is that staff will do as much as they can to help the residents and will talk to the developer.
However, the developer will likely point to the photographs that are available and say that the
liner was operating fine when all of the houses were constructed. This issue will be included on
the agenda of the next Public Works Committee meeting, which will be in September.

Mr. Rothburn stated he is looking for the support from the City to try to resolve this issue, or find
an avenue to do so.

APPROVE AGENDA

Motion by Councilmember Olson, seconded by Councilmember Dehen, to approve the agenda as
submitted.

Motion carried. The sign requested was for the south
leg of the intersection. It has been past practice to post such signs upon request if the end of the
street was not visible from the nearest intersection. In practice, staff has usually posted the
requested signs since many of the dead ends are located in areas without street lighting where a

Public Works Committee / July 17, 2007
