cars to go onto Highway 5 at the last meeting and squabbling over 14 cars at this meeting. This
is considerably more and it is a safety concern.

Councilmember Jeffrey stated the location where these cars will come out is between 146tt, Lord
of Life, and the next street over with no bypass lanes or turn lanes. It is a hazard. If it were
corning out to 146th he would be fine with it. This will force the issue for the City to move
forward and purchase a piece of property at some point in time, which may be what the person in
the middle is looking for. .

Councilmember Elvig stated in all fairness, he thinks the reason this was tabled was because they
felt it was going to fail and they wanted to give the applicant another opportunity. The Council
appreciates that the developer has come back many times. They are trying to make something
work. They are in a situation where they will come down to a vote, most likely tonight. He
would like to explore one more piece of information regarding the potential compromise
Councilmember Olson laid out of a right-out.

Public Works Director Olson indicated the only way to accomplish that is by putting a median
in, which would need to go all the way to 146th Avenue because they would not want people
making a u-turn in the middle of a block.

Councilmember Elvig questioned if a right-out could not be done reasonably or affordably
without impacting the major roadway.

Public Works Director Olson replied there would need to be a hard median put in up to 146th
Avenue. The seven dwelling units coming home in the evening would need to do a u-turn to get
home.

Councilmember Look stated he sees this strip of land that they are discussing as the key to all
three properties developing. He questioned if there is any way to assess the properties at the
point of development to pay for a portion of the cost if the City is required to acquire property to
complete the road.

City Attorney Goodrich replied there could be an assessment if the properties benefit by the
amount of the assessment proposed. There would need to be an appraisal that shows that all the
properties would increase in value by the amount of the assessment. He is not certain if a safer
access would increase the value of the property.

Mr. Jenson indicated it would be questionable whether there would be sufficient value, but in
terms of the possibility of the north property being developable as opposed to what they have
now he would see that as an improvement in their value.

Councilmember Elvig stated if this were denied tonight and a motion were to come forward to
proceed with eminent domain for continuation of the road on the middle parcel, or if a willing
seller proceeds with the middle parcel resulting in gained access, and with the basis that the
church is also a willing seller resulting in continued access, there would be no question in his
mind that the action of taking that property for access purposes would benefit this property.
