<br />Councilmember <br /> <br />moved for the adoption of the following resolution: <br /> <br />RESOLUTION #07-10- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0452 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT AMENDMENT TO ALLOW <br />MOTOCROSS, SNOWMOBILE RACING, DEMOLITION DERBY, AND RODEOS <br /> <br />WHEREAS, Diamonds Sports Bar & Grill, Inc., hereinafter referred to as "Applicant'" <br />has properly applied for.a Conditional Use Permit Amendment to allow motocross, snowmobile <br />racing, demolition derby, music events, and rodeos on the subject property generally known as <br />7550 Highway # 1 0, legally described as: <br /> <br />Lot 1, Block 1, The Diamonds, Anoka County, Minnesota <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on October 4th, 2007 and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference.. <br /> <br />2. That the subject property is located ill the B-2 Highway Business District and IS <br />approximately 16.6 acres in size. <br /> <br />3. That the surrounding parcels to the south and east are part of the Mississippi West <br />Regional Park, the property to the west is zoned B-2 Highway Business, and the property is <br />bounded to the north by Highway # 10. <br /> <br />4. That there is approximately 1,100 feet between the nearest residential neighborhood and <br />the proposed outdoor recreational uses. <br /> <br />5. That the nearest point of the Subject Property is approximately 1,000 feet from the <br />Mississippi River but is not included in the Critical River Overlay District. <br /> <br />6. That Section 9.20.22 (B-2 Business District) allows outdoor commercial recreation with <br />the issuance of a conditional use permit. <br /> <br />7. That the Applicant is seeking to utilize the Subject Property for motocross, snowmobiling <br />racing, demolition derby, rodeos and outdoor music events; and does not intend to obtain <br />special events permits for each event. <br /> <br />8. That City Staff research of a similar uses identifies noise levels as potential nuisances, <br />specifically with reference to the motocross activities, and that no information has been <br />provided with regard to the sound impacts ofthe proposed use. <br /> <br />18 <br />
