<br />202. Definitions
<br />As used in this Drdinance, the fDlIDwing WDrds
<br />and terms shall have the meanings specified
<br />herein:

<br />Affordable means either a sales price that is within
<br />the means Df a mDderate-incDme hDusehold or a
<br />rental amount fDr housing that is within the means

<br />Cluster (Dr Clustering) is a Site-planning tech-
<br />nique that CDncentrates buildings and structures
<br />in specific areas on a lDt, site, Dr parcel tD allow

<br />Dpen space, or preservation of features or struc-
<br />tures with environmental, historical, cultural, or
<br />other significance. The techniques used to con-
<br />centrate buildings may include, but shall nDt be

<br />limited to, reduction in lot areas, setback
<br />requirements, and bulk requirements, with the
<br />resultant open space being devoted by deed
<br />restrictions fDr Dne or more uses.
<br />
<br />Cluster deveiDpment, residential refers tD a land
<br />development project in which the site planning
<br />technique of clustering dwelling units is
<br />emplDyed.
<br />
<br />CDmmDn open space is the pDrtiDn Dfthe site
<br />set aside in perpetuity as Dpen space. This area
<br />may include coasta.l and freshwater wetlands,
<br />flbOdplains or flDod-hazard areas, stream cDrri-
<br />dDrs, prime agricultural lands, habitats Df
<br />endangered wildlif~ as identified Dn applicable
<br />federal Dr state lists, scenic views, histDrical Dr
<br />cultural features, ~rchaeDlogical sites, Dr Dther
<br />elements to be prqtected from development, as
<br />well as easementsJDr public utilities.

<br />recreational, open space, and or/mixed uses
<br />as ar.e provided for in the zoning ordinance.
<br />
<br />Lot means either: (a) the basic development unit
<br />for determination of area, depth, and other
<br />dimensional variations; or (b) a parcel of land
<br />whose boundaries have been established by
<br />some legal instrument, such as a recorded deed
<br />or map, and recDgnized as a separate iegal
<br />entity for purpDses Df transfer Df title.
<br />
<br />Low-income household is one whDse gross
<br />annual income dDes nDt exceed [so] percent of
<br />the area median as adjusted for household size.
<br />
<br />Moderate-income household means a house-
<br />hold whDse gross annual incDme is less than
<br />[Bo] percent Df the area median as adjusted rDr
<br />househDld size.
<br />
<br />Net buildable area means the portiDn of the
<br />cluster develDpment that may be developed or
<br />used for CDmmon Dpen space, whether publicly
<br />dedicated Dr private, but excluding private
<br />streets, public streets, and Dther publicly dedi-
<br />cated improvements.
<br />
<br />Site plan means the development plan fDr Dne or
<br />more lots Dn which is shown the existing and the
<br />proposed conditions Dfthe IDt.
<br />
<br />Street, private is a local roadway serving only abut-
<br />ting lots, not publicly dedicated or maintained by
<br />the ~ocal government] but meeting specific munic-
<br />ipal improvement standards and providing accesS
<br />fDr service and emergency vehicles.
<br />
<br />Street, public means aU public property reserved
<br />Dr dedicated for street traffic.
<br />

<br />Development means the construction, recon-
<br />structiDn, cDnversion, structural alteration, relD-
<br />cation, or enlargement of any structure; any
<br />mine, excavation, landfill or land disturbance;
<br />and/Dr any change in use, Dr alteration Dr exten-
<br />sion of the use, Df land.

<br />Gross area is the tDtal area of the site, includ-
<br />ing the net b:uildable area and public rights-of-
<br />way.
<br />
<br />Infrastructure refers tD the facilities and services
<br />needed tD sJstain residential, commercial,
<br />industriaL inStitutional, and other activities.
<br />
<br />Land develppment project means a prDject in
<br />which Dne Dr more IDts, tracts, Dr parcels Dr
<br />land are tD ~e develDped or redeveloped as a
<br />CDDrdinated site fDr a cDmplex Df uses, units,
<br />or structures, including, but not limited tD,
<br />planned de~elopment and/or cluster develop-
<br />ment fDr residential, commercial, institutiDnal,
<br />

<br />Strucrure means anything constructed or
<br />erected that requires location Dn the ground Dr
<br />attached tD sDmething having location Dn the
<br />ground.
<br />
<br />There is a fair degree of debate about
<br />whether the area of a cluster development
<br />should be limited. Because cluster develop-
<br />mentis fundamentally a design review
<br />process, in theo'ry the approach should be
<br />applicable to a site of any size. However, it
<br />may be that, for smaller sites, a cluster devel-
<br />opment may not yield any appreciable bene-
<br />fits over conventional subdivisions. Conse-
<br />quently, the decision to authorize cluster
<br />development will depend on the policy prefer.
