<br />Board Member Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-08-179 <br /> <br />A RESOLVTION ADOPTING FINDINGS OF FACT #0802 RELATING TO A <br />REQUEST FOR A VARIANCE TO ALLOW THE CREATION OF A NEW LOT TO BE <br />SERVED BY A SEPTIC SYSTEM IN THE METROPOLITAN URBAN SERVICE AREA <br />(MUSA) <br /> <br />WHEREAS, Chad Weich, hereinafter referred to as "Applicant", has properly applied for <br />a Board of Adjustment variance from the requirement for all new lots in the MUSA to be served <br />by City sewer and water service establishes in Section 9.20.1'1 Subd. 1 of the Ramsey City Code, <br />in order to construct a dwelling on the following legally described property: <br /> <br />Outlot A, Alpaca Estates 3rd Addition, subject to easement of record, Anoka County, <br />Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.07 of the Ramsey City Code on August 2, 2007, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated a <br />part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-1 :MUSA and is an existing lot of record. <br /> <br />3. That the Subject Property is surrounded by parcels R-1: MUSA. <br /> <br />4. That the Subject Property is an outlot platted as part of Alpaca Estates 3rd Addition. <br /> <br />5. That the Subject Property appears to be a remnant parcel left over after the other residential <br />lots-in Alpaca Estates were laid out on 142nd Avenue. <br /> <br />6. That at the time of platting (1985), the area of Alpaca Estates 3rd Addition was located within <br />the Rural Service Area of the Critical Area Overlay District, which required a 2.5-acre <br />minimum lot size. <br /> <br />7. That since 1985, the entire Mississippi riverfront has been included within the Urban Service <br />Area. <br /> <br />8. That the Urban Service Area of the Critical Area Overlay District requires 20,000 square feet <br />fQr riparian lots. <br />
