CITIZEN INPUT

Mr. Mike Rolfe, 6341 - 172nd Lane N.W., stated that a mining permit will mean that there will be
a gravel pit. He asked for assurance that there will be no production of crushed rock material,
bituminous or ready mix materials.

Mr. Thompson stated that he is not setting up asphalt production. His proposal is to level the hill.
The elevation is currently at 899, and he proposes to cut it down to 874. The finished elevation is
estimated to be 871 for a relatively flat site with a 1 percent slope to the adjacent wetland. There
will be no separating of soils, no rock crushing and no asphalt batch plant.

Mr. Thompson's next door neighbor asked what the working hours would be for this project.

City Engineer Steve Jankowski stated that working hours are specified by City ordinance and in
the permit to be 7:00 a.m. to 8:00 p.m.

Mr. Thompson's neighbor asked if there would be work on Saturday and Sunday.

Commissioner Deemer stated that no work would occur on Saturday and/or Sunday unless it is
specifically approved by the City.

Zoning Administrator Frolik noted that the City code does not prohibit Saturday work hours.

Mr. Thompson's neighbor asked if the work hours could be limited to normal business hours
because the work hours should conform to what is acceptable to adjacent residents.

Mr. Thompson stated that he does not yet have a contractor to buy the fill. The reason he
requested a 5oyear permit is that it may take to three years to market the soil properly. The
purchase agreement for the fill will stipulate its use.

Commissioner Holland asked if Mr. Thompson would agree to working hours between 8:00 a.m.
and 6:00 p.m.

Mr. Thompson stated that he would prefer to be able to work until 8:00 p.m.

Mr. Thompson's neighbor expressed concern about noise control, erosion control and restoration
control.

Mr. Thompson stated that his proposal is to not have more than 50 percent of the site bare with
the top soil removed at any one time. Top soil will be stock piled on the north slope of the hill.
After the first 50 percent is excavated, the top soil will be put back.

City Engineer Jankowski stated that conditions need to be added to the final plan. The erosion
control plan of a silt fence must be maintained or a secondary erosion control measure added
when more than 50 percent of fill is removed.

Public Hearing/Planning Commission/February 4, 1997
Page 2 of 4
