Mr. Goodrich stated that he thinks it's irrelevant whether this language is in or out of the
ordinance. He thinks it is implied that City Council has the right to deny the use. If lease-term
language is included in the ordinance, the applicant may feel the City must grant the lease. Vice-
versa, because the language is in the ordinance, it doesn't mean you can't put it in the lease also,
but, as time goes by, the City will no doubt want additional lease terms that aren't proposed at
this time in this ordinance.

ADJOURNMENT

Motion by Commissioner Deemer and seconded by Commissioner Terry to adjourn the public
hearing.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Jensen,
LaDue and Thorud. Voting No: None. Absent: Commissioner Holland.

The public hearing adjourned at 10:55 p.m.

Respectfully submitted,

S~lvi~ Frolik -
Recording Secretary

Planning Commission/Public Hearing/Tower/April 1, 1997
Page 4 of 4
