The developer of GAD's Prairie has expressed a willingness to <br />contribute to the cost of acquisition and construction, but would seek a revised preliminary plat <br />to increase the number of proposed units on his property. <br /> <br />Councilmember Dehen stated that he would like an opinion from the City Attorney on whether <br />the City can require the developer to pay for the road construction. <br /> <br />Public Works Director Olson stated that the $40,000 is only the land cost and does not include <br />any possible condemnation costs, which would bring the cost closer to $100,000. <br /> <br />Chair Elvig stated that he is unhappy with the location of the road and would like some sort of <br />buffer along the edge. <br /> <br />. There was discussion about the City's possible financial con,tribution to the construction of this <br />road. <br /> <br />Motion by Councilmember Olson, seconded by Chair Elvig, to recommend to the City Council <br />that the City inform GAD's Prairie that contingent upon City Council approval, the City will <br />supply the necessary land for the road, which will be a cul-de-sac and that there will be <br />mitigation for light bleeding from parallel roads. <br /> <br />Further Discussion: Councilmember Dehen suggested that the City contact the two property <br />owners to see how much this will cost before moving forward. Chair Elvig stated that he agrees <br />that the Committee will need to know costs, legal opinions, etc. before this is brought to the City <br />Council, however, he would like to move this forward to see what the developer will do. <br />Councilmember Olson stated that the Committee may not want to make a motion then because <br />that commits the City to the land costs. <br /> <br />Councilmember Olson accepted a friendly amendment, seconded by Chair Elvig, that the City <br />costs are not to exceed $100,000 for purchase of property, . that this is contingent upon City <br />Council approval, that the road will be built to City standards and not be a private road, that <br />berming or other buffering will be done to mitigate for lights. <br /> <br />Further Discussion: Councilmember Dehen stated that he is really struggling with the idea of <br />using $100,000 of public money to put in this road. He stated that he would like to see costs not <br />exceed $50,000. Public Works Director Olson suggested that the City could offer to cover land <br />costs, but the developer would pay all condemnation costs. <br /> <br />Councilmember Olson accepted a second friendly amendment, seconded by Chair Elvig, to <br />amend her motion to state that the City contribution to the cost of purchasing land will not <br />exceed $60,000 and that anything beyond that, including legal fees, will be covered by the <br />developer. <br /> <br />Amended motion carried.
