<br />Public Works Director Olson stated that there was migration of the water and the dye cloud <br />created did move. He stated that the City does not know where it ended so would like to put <br />more dye on the north end where there have been some lots graded differently to see what is <br />happening. He stated tha~ he does not want to point fingers because the City does not have <br />enough information, other than the fact that the water is going down everyday. <br /> <br />Chair Elvig asked if the City would have some answers in 30 days. <br /> <br />Public Works Director Olson stated that the City should have more information by the October <br />Public Works meeting., <br /> <br />Mr. Rothburn stated that at the July meeting there was discussion that the City would look at the <br />warranty ofthe liner and check to see that it was installed correctly. <br /> <br />Public Works Director Olsor stated that the City is beyond the 12 month warranty period. <br /> <br />Mr. Rothburn asked ifthe City was sure that the warranty period had expired. <br /> <br />Public Works Director Olson stated that generally there is a 12 month warranty period. <br /> <br />Mr. Rothburn stated that he would like to know the name of the product so he can do some <br />research into it onhis own. <br /> <br />Civil Engineer McDowell stated that he can get this information to Mr. Rothburn. <br /> <br />Chair Elvig stated that this is not an agenda item for tonight, but that it will be on the October <br />agenda for further discussioJ,l. <br /> <br />Councilmember Dehen ask~d, from a litigation standpoint, how you know that the manufacturer <br />did anything wrong. He stated that the first thing the manufacturer will ask is how you know it <br />was us and not the property owner. <br /> <br />Mr. Rothburn stated that this is why he wants to get the product specifications to see if the <br />product was defective or had any problems. <br /> <br />Civil Engineer McDowell stated that he will follow up with Mr. Rothburn and get him the <br />product information. <br /> <br />Public Works Director Olson stated that if the City pinpoints that the problem is a failure in the <br />liner, that will get a different action from the City than if the problem was caused by <br />unauthorized digging by a property owner. <br /> <br />Mr. Rothburn stated that it would be easy to take a look at surveys of each lot and their elevation. <br /> <br />Public Works Director Olson stated that this could be done but it would be quite expensive. <br /> <br />Public Works .Committee I September 18, 2007 <br />Page 2 of 23 <br />
