Absent: Chairman Bawden, Commissioners Jensen and Holland. <br /> <br />The motion by Commissioner Terry to amend Findings of Fact No. 27 to indicate "will not" failed for <br />lack of a second. <br /> <br />Commissioner LaDue stated he believes the Finding of Fact No. 27 should be deleted because these <br />issues will be dealt with in the development contract. Zoning Administrator Frolik suggested <br />including the wording "under the City's ordinance" so the use will not contain conditions that would <br />be detrimental. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Terry to accept Finding of Fact No. <br />27 as amended to indicate that proposed uses and activities are controlled by City Code and should <br />the permit be granted, these private fights will be protected by the Code under the contract the <br />permittee signs with the City. <br /> <br />Motion carried. Voting Yes: Acting Chairperson Deemer, Commissioners LaDue, Terry, and <br />Thorud. Voting No: None. Absent: Chairman Bawden, Commissioners Jensen and Holland. <br /> <br />Motion by Acting Chairperson Deemer and seconded by Commissioner LaDue to add Finding of No. <br />Fact 28 indicating that the excavation on the southeast side of the project will leave an 18 foot high <br />bluffalong Sunfish Lake and a 13 foot high bluffon the eastern wetland. <br /> <br />Motion carded. Voting Yes: Acting Chairperson Deemer, Commissioners LaDue, Terry, and <br />Thorud. Voting No: None. Absent: Chairman Bawden, Commissioners Sensen and Holland. <br /> <br />Commissioner LaDue suggested adding a finding that this parcel is within the Shoreland District of <br />Sunfish Lake. City Engineer Jankowski advised this is already included in Findings of Fact No. 14. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Terry to accept the amended <br />Findings of Fact. <br /> <br />Motion carried. Voting Yes: Acting Chairperson Deemer, Commissioners LaDue, Terry, and <br />Thorud. Voting No: None. Absent: Chairman Bawden, Commissioners Jensen and Holland. <br /> <br />The Planning Commission proceeded to review the terms of the permit. <br /> <br />Acting Chairman Deemer noted the need to correct Term No. 3 to reflect the acreage stated.
