11. Heirs and Assigns. The terms of this Lease apply to the Tenant and Landlord. The <br />terms of this Lease also apply to any heirs or legal representatives of Tenant or Landlord and any <br />person to whom this Lease is assigned. <br />.12. Indemnification. Any and all claims that arise or may arise against the Landlord, its <br />agents, servants or employees as a consequence of any act or omission on the part of the Tenant <br />or its agents, servants, or employees arising from the use of the Leased Premises by Tenant or <br />any third parties shall in no way be the obligation or responsibility of Landlord. The Tenant <br />shall indemnify, hold harmless and defend Landlord, its officers and employees against any and <br />all liability, loss, costs, damages, expenses, claims or actions, including attorney's fees which <br />Landlord, its officers or employees may hereafter sustain, incur or be required to pay, arising out <br />of or by reason of any act or omission of the Tenant, its agents, servants or employees, in the <br />execution, performance, or failure to adequately perform the Tenant's obligations. <br />13. Insurance Requirement. The Tenant agrees, that in order to protect itself and <br />Landlord under the indemnification provisions set forth above, it will at all times during its use <br />of the Leased Premises keep in force policies of insurance in the minimum amounts of <br />$1,000,000 per occurrence. Nothing herein shall be construed to waive or limit any immunity <br />from, or limitation on, liability available to the Landlord, whether set forth in Minnesota Statutes <br />Chapter 466 or otherwise. <br />All such insurance insurance policies shall name Landlord as an additional insured.
