Chairperson Nixt called the regular meeting of the Planning Commission back to order at 8:36 p.m. Motion by Chairperson Nixt, seconded by Commissioner Levine, to make the modifications of the ordinance consistent with eliminating content -based regulation and treating commercial and non - commercial speech temporary signage the same on a temporary basis pending a worksession. Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Brauer, Cleveland, Hunt, Trites Rolle, and Van Scoy. Voting No: None. Absent: None. Case #6: Public Hearing — Proposed Ordinance to Amend Off - Street Parking Regulations in Ramsey City Code; Case of City of Ramsey Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:36 p.m. in order to call the public hearing to order. Public Hearing Chairperson Nixt called the public hearing to order at 8:36 p.m. Presentation Assistant Community Development Director Frolik explained that the significant majority of the code enforcement cases processed by the City relate to junk vehicles. Currently City Code does not place any restrictions on the number of vehicles that can be stored outside on a residential parcel; only that the vehicle must be operable and all but one must be licensed. The City's legal counsel has made it known that regulating outside storage of vehicles and equipment by whether or not they are operable is very difficult. When these types of cases get into the court system, the judges generally place the burden of proof of `inoperable' on the City. If the property owner is not cooperative with the City's request for proof of operability, then the City fails to make its case unless a warrant is sought. Legal counsel has indicated that the City would be better able to control outside storage of vehicles if it were based on numbers of vehicles as well as operable and licensed. On July 10, 2007, the City Council directed City Staff to draft an ordinance amendment that would establish limits on the number of vehicles and equipment parked and stored outside on residential parcels. City Staff has drafted an ordinance amendment to restrict the number of vehicles and recreational equipment stored outside on residential parcels as follows: • 1 licensed vehicle per licensed driver in household • 2 additional licensed vehicles per household • 2 major pieces of appropriately licensed recreational equipment (i.e. R.V., Camper, Boat, etc.), • 1 licensed collector or classic vehicle Planning Commission /September 6, 2007 Page 10 of 15
