ADOPT RESOLUTION TO DENY A REQUEST TO REZONE PROPERTY <br />RELATED TO THE PLAT OF EBONY WOODS; <br />CASE OF DAN MURPHY AND TIM HOLM <br />By: Amy Geisler, AICP, Associate Planner <br />Background: <br />As Council will recall, the preliminary plat, preliminary site plan, rezoning, and comprehensive <br />plan amendment related to the plat of Ebony Woods were all denied at the October 9, 2007 City <br />Council meeting. The Council directed Staff to initiate a comprehensive plan amendment and <br />rezoning to change the parcel's designation to Low Density Residential, which will be before the <br />Planning Commission at their November meeting. <br />On October 9 the City. Council adopted findings of fact to deny the rezoning related to Ebony <br />Woods, however, no specific motion was made to deny the rezoning. The City Attorney has <br />recommended that such an action be taken. <br />The following items are enclosed for your information: <br />a) Adopted Findings of Fact <br />Council Action: <br />Motion to deny the request to rezone Parcel 34- 32 -25 -13 -0036 from B -2 Business to Planned <br />Unit Development (PUD), based on Findings of Fact # _ <br />Reviewed By: Z • <br />City Administrator: <br />Community Develo ent Director <br />EM <br />
