Case #13: ~equest for an Extension to Implement the Conditional Use Permit for a <br /> ~ Recycling Facility for Metals and Landscape Timbers; Case of St. Paul <br /> Terminals, Inc. <br /> <br />Community Development Director Frolik stated that On June 26, 2001, the City issued a <br />conditional Ise permit to St. Paul Terminals to operate a recycling processing facility for metals <br />and landsca De !im. bers at 14050 Basalt Street. NW (site formerly occupied by Danny's <br />Aluminum , rocg:ssmg, Inc.). City Code states that the applicant has one year to initiate the <br />conditional use ~ermit unless they request and receive an extension. The extension must be <br />reviewed by!he Planning Commission and City Council, St. Paul Terminals did not initiate their <br />conditiona!~se l~crmit by June 26, 2002. On March 20, 2002, the City received a written request <br />from Bradley~ J. Mart~nson, legal representative for St. Paul Terminals, requesting an extensmn to <br />initiate the ~onditional use permit. The stated reason for the delay in initiating the use is <br />economic conditions in the recycling industry. The City Council granted St. Paul Terminals a <br /> ~ . <br />one year ex~nsi~on to complete their conditional use permit by June 26, 2003. On April 30, <br />2003, the City received a letter from Bradley J. Martinson, legal representative for St. Paul <br />Terminals, s~ting that St. Paul Terminals will be open for business on a limited basis but it is not <br />likely that they Will be able to completely implement the conditions of the conditional use permit <br />prior to Junef 26,12003. Consequently, St. Paul Terminals is requesting another extension of the <br />conditional t~se l~ermit. As mentioned earlier, a request for extension must be reviewed by the <br />Planning Co~mission and City Council. Unfortunately, Staff did make an error in scheduling <br />and the requ~,st f~r extension has not been reviewed by the Planning Commission. The request is <br />proposed to l~e oh the July agenda for the Planning Commission. The current extension expires <br />on June 26;I th~ soonest City Council can take action on the request is July 15. Staff <br />recommende~t tl~at City Council grant a 21 day administrative extension to the conditional use <br />permit to allow ~he Planning Commission the opportunity to consider the request and make a <br />recommendation ;to City Council. <br /> <br />Motion by 0ou~cilmember Elvig, seconded by Councilmember Kurak, to grant a 21 day <br />extension to julyl 17, 2003 relating to the conditional use permit issued to St. Paul Terminals for <br />f~ili~y <br />a recycling . <br /> <br />Motion carriO~d. Voting Yes: Mayor Gamec, and Councilmembers Elvig, Kurak, Cook, Pearson, <br />and Zimmerrfian.i Voting No: None. <br /> <br />Case #14: Consider Authorization of Utility Easement Compensation with the City of <br /> A~ioka Utilities <br /> <br />City Admini~ trat0r Norman stated that the cities of Anoka and Ramsey entered into a right of <br /> [ <br />entry agreement [.on July 11, 1995, whereby Ramsey granted Anoka access to its parcels for <br />construction 9f tlSe electrtcal utd~ty line. The agreement described the spemfic Ramsey parcels <br />and permitted~ An~oka to commence construction immediately, but it did not provide for payment <br />of Ramsey's darn~ges. Negotiations have continued for close to eight years.
