CASE # <br /> <br />REQUEST TO RENEW A CONDITIONAL USE PERMIT TO <br />MINE AND EXPORT SOILS; CASE OF SIDNEY NYHUSMOEN <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On April 26, 1994, the City Council granted a conditional use permit to Sidney <br />Nyhusmoen to mine and export soils from Lot 1, Block 1, HY-10 Ramsey 4th Addition. <br />That permit was issued with an expiration date of May 1, 1997. <br /> <br />Notification: <br /> <br />In accordance with State Statute, surrounding property owners within 350 feet were <br />notified of the public hearing to renew the permit. <br /> <br />Observations: <br /> <br />On February 6, 1997, the City received a written request from Mr. Nyhusmoen for a <br />renewal of the permit because the project had not been initiated during the initial 3 year <br />permit. In accordance with City Code, Staff scheduled a public hearing in front of the <br />Planning Commission on March 4 to consider renewing the permit. The Planning <br />Commission conducted the public hearing and there were no written or verbal comments <br />submitted from neighboring property owners. <br /> <br />The subject property is approximately 4.4 acres in size, zoned Industrial and surrounded <br />by industrially zoned property. The grading plan proposes no importing of fill materials, <br />no blasting and no impact to drainage. The specifics of the proposed project have not <br />changed. The Applicant is proposing to strip the topsoil, export approximately 14,730 <br />cubic yards of material and replace the topsoil. The property has a wide range of <br />topography elevations and the Applicant has stated that the mining and exporting of soils <br />will prepare the site for future development.
