<br />involvement and he would like to know that the City Hall and the City Council will support the <br />police department. <br /> <br />Mayor Gamec stated that he feels this is a test to show the City can follow through and do a good <br />job enforcing its ordinances. He stated that the City has tried using the court system in this case, <br />and that has not worked. ' <br /> <br />City'Attorney Goodrich stated that Police Chief Way is looking for a consensus from the City <br />Council that, if force is used, the City Council will back the department. <br /> <br />Councilmember Elvig asked if there was any validity to the comments claimed in the No <br />Trespassing document. <br /> <br />City Attorney Goodrich stated that he believes it is a meaningless document and would mean a <br />major challenge to the constitution if these claims were upheld. He noted that no courts have <br />upheld these types of claims in the past. <br /> <br />Councilmember Strommen stated that she feels the City has given ample time and have <br />exhausted other options in this situation and supports any action the Police Chief feels needs to <br />be taken. <br /> <br />Councilmember Jeffrey stated that he is fully behind the Police Chief and asked if there was a <br />date scheduled for the confrontation. He stated that he feels the City Council should know when <br />it will happen, so they can be prepared. <br /> <br />City Attorney Goodrich reviewed the process so far in serving the landowner with a certified <br />letter and a given time for filing ,an official appeal. He stated that the City will send another <br />letter that states the violation of City Code and that the City has the right to come on the property <br />to correct this violation. <br /> <br />Police Chief Way asked who would sign this letter. <br /> <br />City Attorney Goodrich stated that it will be signed by City Administrator Ulrich. <br /> <br />Councilmember Dehen stated that he does not think anyone on the City Council wanted the <br />situation to come to this and feels it is the landowner who has escalated the situation. He stated <br />that he gives his full backing to Police Chief Way. He stated that he feels Police Chief Way is <br />within his rights to follow through as he sees fit and should not need to come before the City <br />Council at a work session to get permission. <br /> <br />Mayor Gamec stated that this will be the first time this ordinance has been used and feels it was <br />appropriate for the Police Chief to come in and explain the situation to the City Council. <br /> <br />Councilmember Jeffrey asked if there were other properties that were in process for this new <br />ordinance. <br /> <br />City Council Work Session / October 9, 2007 <br />Page 5 of6 <br />
