<br />held during the summer as well. Additionally, the applicant is requesting twQ wintertime <br />snow boarding events. All events will require the use of a P A speaker system that will be <br />permanently.installed on the property. Mr. Gruber has submitted a noise impact study <br />that was conducted at motocross events in northern Minnesota. The applicant does not <br />plan to use any additional measures for sound mitigation, beyond existing berming, and. <br />has also submitted data with regard to the parking/traffic flow situation. A summary of <br />this information is included in your packet. Anoka County Parks and many residents have <br />submitted letters in opposition to the Diamonds' request. <br /> <br />Staff Recommendation: <br /> <br />Staff recognizes the need to. support community businesses and events that many <br />members of the community support. Also, there has been little evidence that the sound <br />emitted from the motocross events will exceed 60 db(A) more the 10% of the time <br />(maximum limit in City Code before sound is considered a nuisance). However, staff also <br />recognizes the impact a change in sound will have on the livability of the neighborhood, <br />and possibly the habitat along the River. Also, there will be a PA system at each event, <br />. which will have an unknown impact on the overall sound levels. It is Staff's belief that, <br />while the -sound will perhaps not exceed the maximum sound level stated in City Code, it <br />may still be a nuisance to those properties. <br /> <br />Based.on review of the submitted data, Staff cannot recommend approval of the request <br />unless the following criteria are met: <br />1) The applicant reduces the number of summertime events. Under the existing <br />proposed schedule, there would be two of.these events each month in June, July, August, <br />and September. Without having sound data specific to the site with the proposed events <br />and P A system, it is impossible to anticipate the impact these events will have on the <br />surrounding neighborhood and Mississippi River recreation and habitat area. Therefore, if <br />the City Council and Planning Commission are inclined to be supportive of the general <br />uses on the property, Staff recommends allowing a maximum of one event each <br />summertime month (May through September) and two other events during the wintertime <br />months (October through April), for a total of seven events, rather than thirteen. <br />2) . Planning Commission and City Council direct Staff to conduct measurements <br />of the noise impacts during these events at various distances and points along the river <br />and in adjoining neighborhoods, to document all noise complaints during these events, <br />and to prepar.e a report at the end of 2008 with regard to the noise impacts these types of <br />events have on the property. <br />3) The issuance of a one-year Interim Use Permit is granted for the specified <br />number of events, and allows flexibility for revising the type and/or number of events, <br />basedon the outcome of the noise impact study. <br />4) A special events permit is. obtained for each type of event (motocross, mus'ic <br />events, demo derby, androdeos/bull riding.) <br /> <br />. As noted above, Staff will provide a verbal report of the outcome of the October <br />30th work session at the Planning Commission meeting. <br /> <br />2 <br />
